  2. TexasEasyLien.com Compared to a Lawyer Mechanics liens are an extremely useful tool for contractors and anyone who provides services or materials to a construction project and does not get paid for the work performed. They, however, must contain specific information to make them valid and enforceable. Since construction liens used to be filed only by attorneys in Texas, contractors did not keep interest in the language or information it should include. But since online services like Texas Easy Lien exist, contractors and suppliers can now be in change of filing their own liens pushing them to learn the important details they must keep for further use. Online services are designed to fill in the legal terms and required language that the law requires mechanics liens to include. This makes it much easier since all contractors need to know are the details of the contract, the project and the unpaid work. We have created a list of the necessary information any contractor must know to file a mechanics lien.

  3. The lien affidavit must include the following: 1. A sworn statement which includes the total amount of the claim. 2. The name and the last known address of the owner, the reputed owner of the property and the lessee. 3. Description of the work and materials furnished and unpaid for each separate month. 4. Name and the last known mailing address of the person or company by whom the claimant was employed by and any others above them (if applicable). 5. Name and the last known address of the original contractor. 6. Legal description of the property sought to be charged with the lien or a valid common address. 7. The claimant’s name, mailing address, and, if different, physical address. 8. Date and delivery method of all notices sent prior to the filing of the lien. • The lien affidavit must be signed by the person who is claiming the lien or by any other person who is legally entitled to claim on behalf of the company. The claimant must send the copy of the mechanics lien affidavit by certified mail to the owner, and general contractor (if applicable) at their last known business or the residence address not later than the 5th day after the date of the lien affidavit is filed with the county clerk.

  4. How can you file mechanics lien in Texas? The “accrual” date varies depending on whether the claimant is an original contractor or a subcontractor. The debt to an original contractor accrues on the last day of the month in which the contract was terminated, completed, finally settled, or abandoned. Indebtedness to a subcontractor accrues on the last day of the month in which the labor was performed or the material furnished. Before filing a lien affidavit, subcontractors must send notice of the unpaid claim to the owner and the original contractor no later than the 15th day of the third month after the work was performed. Sub-subcontractors need to send a timely notice to both the original contractor and the property owner or reputed owner not later than the 15th day of the second month after the work was performed. These notices must be sent by certified mail to their last known business or residential address. When a lien has been successfully filed by the claimant, the lien will be valid for 2 years on commercial projects and one year for residential, if payment is not submitted in that time lawsuit to foreclose the lien is the step to follow.
