The Department will grant time extensions when Work on the critical path is delayed and impacts the completion date • Contractor obligated to mitigate delays • Delays fall into two types of categories
1. Excusable (time), Non-Compensable (no money) • Delays not the fault of the Contractor or the Department • Floods, tornados, lightning strikes, earthquakes, or other cataclysmic phenomena of nature • weather • Extraordinary delays in material deliveries (area-wide material shortages, freight embargo, government acts) • Civil disturbances • Fires or epidemics • Labor strikes • Added quantities • Any other delay not the contractor’s or Department’s fault
2. Excusable (time), Compensable Delays (money) • Delays that are the Department’s fault • Revised work • Utility or railroad interference • Engineer ordered suspensions • Acts of government other than the Department • Neglect of the Department
Compensable Items limited to the following: • Extended labor • Escalated labor • Idle equipment • Material escalation • Field overhead • Home office overhead
