  2. A History Lesson • First used hundreds of years ago • Factored in the events that led to the Revolutionary War. • Our Constitution guarantees the right to a jury

  3. Jury Administration • Authority… • Florida Statutes… Chap. 40 & 905 • http://www.flcourts.org/gen_public/jury/jurorpool_plans.shtml

  4. Chief Judge will review and consent to the process for selection • ( F.S. 40.001) • Clerk shall implement electronic system • Clerk of Court shall submit plan for selection of candidates to Chief Justice.

  5. Candidate Qualifications • 18 yrs of age • Citizen of U.S. • Legal Resident of State & County • Possess DL or Photo ID Card • In lieu of above, execute affidavit per F.S. 40.011

  6. Jury List • Generated by DHSMV quarterly • Names can be added by Affidavit • Clerk to purge list monthly: • Adjudicated mentally incompetent • Convicted of a felony • Dept. of Health to furnish list of deceased monthly • Clerk responsible for preserving security and source of list

  7. Summoning Jurors • Generate Venire (list of jurors) • Issue Summons to attend court with at least 14 days notice • Can postpone up to 6 months • Failure to appear up to $100 Fine & possible contempt of court • Reschedule of no-show’s • May be put on notice and called in an hour’s notice

  8. Juror Compensation • $15.00 per day/ first three days • $30.00 per day/ four days or more • Exemptions: • Employer pays 1st three days • Excused at their request • Juror may donate per diem

  9. Juror Compensation cont. • Payment within 20 days after completion of service • Compliance is monitored thru external audit function

  10. Juror Accommodations • Clerk pays • Required by law or ordered by the Court • Separate facilities for sexes shall be provided

  12. Summons Date • Juror Check In process • Report Time • Clear signage • Check DL • Know authority of Clerk • Provide Jurors info & expectations • Video • Swear in Jurors • Judicial excusal

  13. Grand Jury • Consists of not fewer than 15 nor more than 21 • Selection is no less than annually • Order from Judge to issue summons to impanel grand jury • Governance same as petit jury • Clerk administers oath • Clerk maintains witness list &minutes
