State & Federal Entities Rules Falls (.0281) & Jordan (.0271) • Stormwater requirement for state & fed lands • Similar to requirements for local governments • New Development - N&P export targets • Existing Development - % reduction goals • NCDOT requirements • New Development • Non-road projects meet export targets • New DOT road projects meet buffer requirements • Existing Development • Minimum of 6 (Falls) & 3 (Jordan) BMP retrofits per year

Accounting Framework • DWQ to submit nutrient accounting framework for EMC approval • Framework to include tools for quantifying: • Loading from new and existing development • Load reduction credits for various activities • Loading changes due to BMP implementation • Reduction assignments on existing development • Falls accounting framework to also include: • Existing development baseline loads for NCDOT

Non-DOT State & Federal Stormwater Nutrient Accounting Tool • Same tool as approved by EMC in March 2011 • Jordan / Falls Lake Stormwater Nutrient Accounting Tool (JLSLAT) • Developed by NCSU • Estimates loading from Pre- and Post-development • For use with new development & existing development • Loading Changes due to BMP implementation • Advances over previous tools (Tar-Pam, Neuse) • Fixed BMP effluent concentrations • BMP volume reduction credit • Updated runoff nutrient concentrations • Applies across physiographic regions

NCDOT Stormwater Nutrient Accounting Tool • NCDOT created modified version of JLSLAT tool • Developed by NCDOT & NCSU • For use with new & existing development • Differences in tools • NCDOT version includes additional land cover categories • Land cover and BMP effluent concentrations based on NCDOT research • NCDOT tool calculates loads in same manner and uses same equations as already approved JLSLAT tool

Tools for Existing Development Credits For Various Activities • “Various Activities” = non-BMP • Examples: Fertilizer ordinances, disconnecting impervious • Nutrient Science Advisory Board (NSAB) currently working on assigning credit to these activities • Crediting for “various activities” will be part of Existing Development programs submitted to EMC • July 2013 -Falls • September 2014 & 2017 - Jordan

Tools for Existing Development Load Reduction Assignments • Non-DOT Load Reduction Assignment • Falls : Stage I - Offset increase in loading since baseline • Jordan : Based on watershed remodel (underway) • JLSLAT tool used for accounting • NCDOT Load Reduction Assignments • Falls: Baseline loads based on Watershed & Lake Model • Jordan: Based on Watershed remodel (underway) • Implementation: 6 BMPs/yr (Falls) and 3 BMPs/yr (Jordan)

NCDOT Existing Development Baseline Loads in Falls Lake • Falls accounting framework requires the development of baseline nutrient loads for NCDOT • Includes existing roadways and NCDOT facilities • NCDOT calculated their baseline loads in collaboration with DWQ • Baseline Calculation Methodology • Derived % of relative load from Falls watershed model • Applied % to tributary load inputs used in Falls lake model

  10. NCDOT Existing Development Baseline Loads - Falls Lake • Reductions will be measured against these baseline numbers • Implementation rate of at least 6 BMP retrofits per year
