Definition of “CAFO” • Confined Animal Feeding Operation as defined in OAR 603-074-0010(3) • The concentrated confined feeding or holding of animals or poultry, including but not limited to horse, cattle, sheep, or swine feeding areas, dairy confinement areas, slaughterhouse or shipping terminal holding pens, poultry and egg production facilities and fur farms; • In buildings or in pens where the surface has been prepared with concrete, rock or fibrous material to support animals in wet weather; or • That have wastewater treatment works; or • That discharge any wastes into waters of the state; or • An animal feeding operation that is subject to regulation as a concentrated animal feeding operation pursuant to 40 CFR 122.23

  4. 2010 CAFO Program Changes • Adoption of new CAFO General #1-2009, NPDES Permit - June 2009. Jointly issued by ODA and DEQ (EQC) • Required Confined Animal Feeding Operations to register (new) or maintain permit coverage • New permit continues merged state and federal CAFO definitions • Permit coverage continues for CAFO’s with wet and dry systems, meeting the confinement definition • EPA involved in litigation on 2008 CAFO Rule (Consolidated in the 5th Circuit))
