  2. Overview of the Hazardous Waste Permits Section The mission of the Bureau of Waste Management is “to minimize the environmental impact associated with the generation, storage, transportation, treatment, and disposal of all solid and hazardous wastes in Kansas”

  3. Overview of the Hazardous Waste Permits Section BWM has the primary responsibility of conducting the monitoring, inspection, permitting, and enforcement activities of the Hazardous Waste Program in Kansas. Most subdivisions within BWM provide support for the program.

Overview of the Hazardous Waste Permits Section The Hazardous Waste Management program is responsible for administering and implementing Subtitle C of the Federal Resource Conservation and Recovery Act (RCRA). RCRA Subtitle C provides the statutory framework for the hazardous waste regulatory program.

Overview of the Hazardous Waste Permits Section RCRA Program Background • RCRA was passed in 1976 and implemented in 1980 • RCRA regulates the generation, transportation, treatment, storage, and disposal of hazardous wastes • 1984 Hazardous and Solid Waste Amendments (HSWA) established the RCRA Corrective Action Program • Administered by EPA and authorized States

Overview of the Hazardous Waste Permits Section Hazardous Waste Permits Section • Manages provisions for the RCRA Base Program and Corrective Action Program • Issues Special Waste Disposal Authorizations • Issues and oversees permits for regulated units, operations, monitoring, post-closure care and corrective action at TSDFs

  7. Overview of the RCRA Corrective Action Program in Kansas TSDFs Facilities that: • Treat hazardous waste, • Store hazardous waste for more than 90 days, or • Dispose of hazardous waste

Overview of the Hazardous Waste Permits Section Permitting of TSDFs • RCRA permits provide TSDF facilities with the legal authority to treat, store, or dispose of hazardous waste, and detail how the facility must comply with the regulations. • A variety of enforceable instruments are currently used for RCRA Corrective Action in Kansas: EPA orders and agreements, RCRA permits, and State orders.

Overview of the Hazardous Waste Permits Section Corrective Action • RCRA facility assessment (RFA) report • RCRA facility investigation (RFI) • Corrective Measure Implementation Work Plan (CMIP) • Construction Completion Report • Corrective Measure Completion Report • Permit modifications will be necessary

Overview of the Hazardous Waste Permits Section Program Funding • RCRA Subtitle C Grant • Annual monitoring fees paid by generators, transporters, and TSD facilities • Offsite treatment fees paid by off-site hazardous waste treatment facilities • Corrective Action (CA) oversight cost reimbursement

Overview of the Hazardous Waste Permits Section GPRA Goals • Government Performance and Results Act (GPRA) goals are high priority national goals tracked by EPA and Congress • RCRA currently has three goals for corrective action that apply to our 2020 baseline facilities: 1) Identify and achieve human exposures under control (CA725) 2) Control migration of contaminated groundwater (CA750) 3) Complete remedy construction (CA 550)

Overview of the Hazardous Waste Permits Section 2019 Activity • One post-closure permit is being finalized • Two operating permits are in public comment period • One permit for corrective action and post-closure activities is ready to be placed in public comment • One permit for corrective action will soon be in comment period • Thirteen permit modifications have been finalized

Overview of the Hazardous Waste Permits Section Looking Forward • Continue with the transfer of corrective action responsibility from EPA to KDHE as permits are reissued • Continue to strive for CA 550, CA 725, and CA 750 goals outlined in Strategic Plan • Goal: Reach all permitting-related decisions within six months • Beyond the 2020 Universe – Portfolio
