  1. Thematic Meeting 3: PSI Re-use Business Christian Lister IPSA Chairman ePSIplus Competition Authorities Thematic Meeting 11 November 2008 (Berlin, Germany). Bundeswirtschaftsministerium (Federal Ministry of Economics and Technology)

  2. The Cast Communities and Local Government Consultations Office of Fair Trading Recommendations OPSI (Office of Public Sector Information) APPSI (Advisory Panel)

  3. CLG CLG's – consultation paper on Local Authorities (Charges for Property Searches) Regulations 2008 CLG consult OPSI and OPSI provide the wording for pages 50 and 51 of the consultation

  4. OPSI is consulted Unrefined property information produced by a public authority as part of their public task will almost certainly fall within the scope of the Re-Use Regulations. The purpose of the Regulations is to ensure that where a public authority responds to a request for re-use, it does so on equal and non-discriminatory terms (see regulations 7 and 13). In the interests of non-discrimination it is important therefore that public authorities apply the same terms of re-use, for similar forms of re-use, to all those re-using the data.

  5. Ouch!!!! “Being shot by friendly fire hurts….”

  6. OPSI didn’t stop there…… …..”The proposed KPMG draft guidance at Annex 6 is compatible with the provisions of the Re-Use Regulations in that it would enable a LA to develop such charges.”

  7. CLG and CLG drew swift comparisons, substantiating it’s reasons for full cost recovery…… ”…information products should be priced at no less than full cost recovery, including any required rate of return. Full costs should include any required rate of return and an appropriate share of any indirect/common costs.”

  8. and the OFT…….?? ….said nothing further. and APPSI had to apologise to CLG… “…. we note that although the draft Regulations on property search charges appear to comply in theory with the Re-use Regulations, we would nevertheless strongly suggest that you consult the Director of OPSI and her team about how best to clarify the relationship between the draft Regulations on property search charges and the Re-use Regulations “

  9. and CLG said…….. “we told you we could charge” I have created this fictional quote. CDL Berlin 11.11.08

  10. We are doing our best It is no use saying, 'We are doing our best.' You have got to succeed in doing what is necessary.

  11. Thank you Christian Lister IPSA Chairman chris@xpresslegal.co.uk
