  2. When a person commits a wrong act against society they have committed an crime. When a person (or group) commits a wrong act against another person (or group) they have committed a tort. - It can be said that criminal law involves a wrong against society and civil law involves a wrong against an individual - All legal cases are in the realm of criminal or civil law

  3. It’s a question of terms.. Make a 3 column chart.. 1. The person bringing the case to court. 2. The decision of the judge or jury is called.. 3. The wrong act is known as.. 4. The judge or jury can decide or award.. 5. The legal question is to establish.. 6. The goal of the trial is to give..

  5. Can you imagine a situation that involves criminal law? Civil Law? Can a situation ever be both?

  6. Major Differences 1. Burden of Proof “The Burden of proof lies with the plaintiff..” In a criminal case, the state must prove their case beyond a reasonable doubt. This means that the jury must be 100% sure that the person did it. In a civil case, the plaintiff must prove their case with a preponderance of the evidence. This means that the jury is 51% sure that the person did it.

  7. Major Differences 2. Outcomes of a Trial In criminal cases the person can be fined, given alternative sentences (probation), sent to prison, or even executed. In a civil case the liable party is usually ordered to pay damages. The Plaintiff may also be awarded an injunction (or court order to force the defendant to cease the harmful activity.)

  8. Important Vocabulary Burden of proof, beyond a reasonable doubt, preponderance of the evidence, tort, verdict, judgment, damages, liability, remedy, injunction I will check binders this Friday. These notes should be in the binder as well as the vocabulary above.

  9. Exit Slip. (1st points of 2nd Quarter.. Can you describe some differences between civil and criminal law. If there is no time to finish it, it is due for homework tomorrow.
