  2. CRUEL AND UNUSUAL PUNISHMENTS CLAUSE • Excessive bail shall not be required, nor excessive fines imposed, • nor cruel and unusual punishments inflicted

  3. Taking power away from the police since 1789 • Gives you protection from: • Exaggerated bail amounts • Ridiculous fines • Getting smacked around for no reason

  4. When things go our way Roper v Simmons - rights were upheld Simmons was sentenced to death in 1993. when he was only 17. they claimed executing minors was cruel and unusual punishment.

  5. Sometimes things don’t go our way Harmelin V Michigan - rights were not upheld Following his conviction under Michigan law for possession of cocaine. Harmelin was sentenced to life in prison with out parole. He challenged the sentence claiming it was cruel and unusual punishment.
