  2. SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION CONTENT • Spanish WO Legislation • WO Management Situation Before WO Act • Current Situation in WO Management in VR • Weakness of the Spanish System SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION

  3. SPANISH WO LEGISLATION -Introduction DIRECTIVE 75/439/ECC on the disposal of Waste Oils entered in force on 18 June 2000 Amended by: Directive 87/101/ECC Directive 91/692/ECC Directive 2000/76/EC Act 28 February 1989, on Waste Oils Management amended by Act 13 June 1990 DECREE 679/2006, 2 June, on Waste Oils Management SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION

  4. WASTE OILS Industrial oil unappropriate for its purpose Generated by Use of Oils, mixtures and emulsions In Spain and also for imports from other MS WO with < 50 ppm of PCBs generated in PCBs oils treatments SPANISH WO LEGISLATION -Industrial Oils And Waste Oils INDUSTRIAL OILS Lubricant oils with mineral basis, synthetic or assimilated from animal origin put in Spanish market (manufatured, imported or purchased from other MS) With CN from COUNCIL REGULATION (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on Common Customs Tariff SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION

  6. SPANISH WO LEGISLATION -Oils Manufacturers Obligations Limit the use of hazardous substances and make waste oils management easier Ensure suitable management (collection and treatment network) of waste oils generated assuming costs WO Packaging according P&WP legislation Oils containers labelled “Act 679/2006” and IMS symbol Selective collection for used containers ElaboratePreventionPlansevery 4 yearsAprovedby R.A. 7. SPANISH WO LEGISLATION -WO Storage/treatment Obligations WO stored in appropriate conditions avoiding mixtures with other waste (i.e. water) The storage facility must be suitable for WO upkeep and collection Avoid negative effects on soil (even for underground storages) WO or residues from WO treatments disposal on soil, surface water, or groundwater is totally forbidden WO thermal treatments according Directive 76/2000/EC WO transport to/from other countries according Regulation 1013/2006 SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION

  16. PREVIOUS WO SITUATION -WO Generation And Managment In VR 25.600 tonnes generated in V.C. were treated in other regions SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION

  17. CURRENT WO SITUATION -Integrated Management Systems Non profit associations Ensure WO selective collection and management according treatment hierarchy Authorised and controlled by Regional Competent Authorities -General Directorate for Climate Change in the Valencia Region- which report to National Ministry Producers shall finance the system by means of a quantity per each kg of industrial oil in order to cover operation deficits Producers shall collect a quantity calculated from oils sold taking into account the average WO generation percentages SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION

  18. CURRENT WO SITUATION -Integrated Management Systems INDUSTRIAL OILS SOLD 2007 PRODUCER’S FINANCIAL CONTRIBUTIONS Initial Contribution Membership fee: 5.000 € (2.000 € if < 2.000 t/y) Periodical Contribution 0,06 €/kg of industrial oil put in Spanish market SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION

  21. CURRENT WO SITUATION -Weakness of the System • Calculation of WO generation rates from oil sold • % of WO generated destined to illegal management activities • Control of efficiency in regeneration processes • Lack of standards/specifications on regenerated basis • Final destiny of regenerated basis • Mixtures of differents types of WO makes regeneration difficult • Regeneration capacity SPANISH EXPERIENCE IN WASTE OILS LEGISLATION IMPLEMENTATION
