Decree n. 367/2004 Coll. of the Ministry of Environment, that amends the Decree n. 7/2000 Coll., that sets the scope and mode of preparation of an announcement of major accident and of a final report on origin and consequences of a major accident. • Decree n. 373/2004 Coll. of the Ministry of Industry and Trade, that sets the details about the scope of safety measures of physical protection of facility or installation inserted in group A or B.

Government Decree n. 452/2004 Coll., that sets the mode of assessment of a safety programme of prevention of major accidentand of a safety report, the content of annual plan of controls, the procedure to realise inspection, the content of information and the content of final report on inspection. (It replaces repealed Decree n. 6/2000 Coll.)

Validity from 1st July 2005.

Some insufficiencies and comments on the safety programme • Evidence of corresponding requirement of safety management system is missing • Brief description of content focus of the document in question is missing • Submission of general statements in the part reserved to system measures, that lead to supposition that operator is in one of the following situation:

Safety management system (SMS) is in operation, but it is described and documented in a wrong way in the document • SMS is not in operation, but a concrete plan how to put it in operation exists (including deadlines and responsibilities), which is nevertheless not described and documented in the document • SMS is not in operation, future operation is not planned, however single safety elements are spontaneously fulfilled thanks to high level of consciousness of the employees • SMS is not in operation, future operation is not planned, single safety elements are not fulfilled    ?  almostincident, incident, accident, major accident !

  32. Statements that should be true • Safety engineering has a correct position • Operator accepts results of the risk analysis and has a functioning risk management system, adequate to sources of risk that have been analyzed • Operator has experts for major accidents prevention • State administration has experts for major accidents prevention and executes effectively land-use planning • Public is adequately informed in the area of major accidents´ prevention • Operator, state administration and public co-operate mutually in order to lower risks reasonably
