  1. Electronically Stored Information & its application Electronic discovery has now become normal and is routinely confronted in civil litigation. Having said this, the Court is aware that the discovery of Electronically Stored Information (ESI) is a probable source of cost, burden, and delay. The purpose of these ESI Principles is to promote reasonable electronic discovery, for the cases, where it is appropriate to conduct such discovery, intending to reduce cost, burden, and delay, however, the purpose remains to secure the just, speedy, and inexpensive determination of every action and proceeding. The ESI Principles also promote the prevention or early solution of disputes regarding the discovery of ESI without Court intervention. While parties are persuaded to discuss the Electronically stored Principles concerning individual cases, complying with them, however, is voluntary and not needed by the Court. The parties should apply the comparison standard set ahead to all phases of the discovery of ESI, including but not limited to the identification, preservation, collection, search, review, and production of ESI while maintaining the truthfulness of the ESI. To assure fairness and balance in electronic discovery, parties should consider the factors as described. To facilitate observance to the proportionality standard, requests for production of ESI and related responses should be prepared in consultation with the following but not limited to custodians, administrators so the resulting discovery is complete, accurate, and as specified as practicable. In many cases, and were steady with the balancing factors, the discovery of ESI will be facilitated by the participation of electronic discovery associations. Also, if a dispute arises that involves technical aspects of electronic discovery, as part of its obligations concerning discovery disputes, each party should consider appointing an ESI associate well-informed of relevant systems and information. ESI associates must be aware of the location, nature, accessibility, collection, and production of ESI in the matter. Talking about the disputes related to ESI that the parties are unable to resolve shall be presented to the Court at the earliest reasonable prospect. The Court may determine that any party or counsel has failed to cooperate or participate in good faith relates to electronic discovery. Every case is specific, and the type of information exchanged should be done to meet the needs. As per the specific case, the parties may reflect exchanging information about the following types of technologies, systems, tools, or protocols as used by the parties: - - - - - - - - Software applications. Document management, and messaging systems. Types of computing devices Use of personally owned devices. The rights of individuals to access the systems, specific files, services, and applications. Network and database structure. use of cloud, or other third-party services, including social media and personal email. Backup, recovery routines.

  2. The parties may decide to consider the organization's charts for relevant policies, including those related to specific departments. Disputes regarding ESI, if cannot be resolved, shall be presented to the Court at the earliest reasonable opportunity. The applicable rules of professional responsibility and other duties of counsel are relevant to electronic discovery.
