BRELLA All Corrective Action Plans must adress: Title 10: Conservation and Development Chapter 159: WASTE MANAGEMENT 10 V.S.A. § 6648. Corrective action plan ***A redevelopment plan needs to be included****** The person receiving the approval shall file the notice of approval of the corrective action in the land records of the municipality in which the property is located within 15 days of receipt of the approval. After completion of all activities required by the corrective action plan, the applicant shall file a completion report (As-Built) with the secretary. The completion report shall include all the following: (1) Description of the activities performed under the corrective action plan and any amendments to the plan. (2) Description of any problems encountered. (3) Certification by the applicant that the activities were performed in accordance with the corrective action plan. Corrective Action Plan Process
After receipt of completion report/As-Built site receives: Certificate of Completion (COC) The rights, obligations, covenants, and restrictions granted in this certificate of completion shall run with the land, and any portion thereof, and shall be binding on the Agency of Natural Resources and successor Agency, and shall inure to the benefit of ____ and its authorized representatives, successors and assigns. All required corrective action has been completed at this site and no further work is required. This Certificate of Completion shall be recorded in the Bennington land records for this property. Once recording is complete, Protection from liability pursuant to subsection 6653(a) of this title is in effect. Corrective Action Plan Process
After receipt of completion report/As-Built site receives: Sites Management Activities Complete (SMAC) Based on the above, the SMS is assigning this site a Site Management Activity Completed (SMAC) designation. This SMAC designation will not release you from any past or future liability associated with the petroleum contamination at the site. It does, however, mean the SMS is not requesting any additional subsurface work in response to the UST removal at _______ in May of 2001. Corrective Action Plan Process
