  2. PUCT Rule • PUCT Rule 25.476 • Renewable and Green Energy Verification – Subchapter R • To establish the procedures by which Retail Electric Providers (REPs) calculate and compose their renewable content • To establish guidelines and verification for claims of “green” products RMS 2

Generator Responsibilities • Not later than March 1, each generation owner shall report the following to the registration agent (ERCOT) for the preceding calendar year: • Net Generation • Provided by ERCOT for ERCOT Polled Settlement Metered facilities • Average Annual Emission Rates • Carbon dioxide, • Nitrogen oxides, • Particulates, • Sulfur dioxide and • Nuclear waste RMS 3

ERCOT Responsibilities • Generator Scorecards • ERCOT creates and maintains generator scorecards for each generation owner for facilities located in Texas: • Generation Fuel mix • Annual Emissions Rates • ERCOT publishes • A state average fuel mix • Statewide average emission rates by emission type • Default fuel mix and emission rates • Published on ERCOT’s web site by April 1 of each year • Renewable Content Calculator found at http://www.ercot.com/mktinfo/retail/electric/index.html RMS 4

REP Responsibilities • Calculating renewable generation and authenticating “green” claims • REPs marketing “green” electricity based on natural gas produced in Texas • Attestation from generators that the natural gas was produced in Texas • Due to ERCOT no later than March 15 of each year • REPs with contracts with out-of state generators needed to authenticate fuel mix • Report annual fuel mix from out-of state generators • Due to ERCOT no later than March 1 of each year • Annual reporting obligation • REPs must update renewable energy percentages on their Electricity Facts Label (EFL) and provide to ERCOT no later than July 1 of each year • For products currently offered or offered during the preceding calendar year • For generation purchased during the preceding calendar year RMS 5

Why are we here? • PUCT has asked ERCOT to notify REPs of the requirements to update EFLs and submit to ERCOT by July 1 • Options: • Renewable energy percentage for each product • Electricity Facts Label for each product • Completed Renewable Content Calculator for each product • ERCOT will send a market notice describing the reporting requirements and process • Any Questions or Concerns • Send to electricitylabel@ercot.com RMS 6
