RMS Approved Resolution • Upon TAC approval, suspend further True-up settlements for 2002 . • True-up resettlement (starting with January 1, 2002) will commence April 1,2003 or upon completion of the criteria below; whichever occurs first. Any discrepancies after the deadline must be accepted by all parties. Progress toward completion criteria will be reviewed at each RMS meeting. • Develop functionality and provide data extract as defined in SCR 727. RMS places a High-High project approval/priority to SCR 727. • Market Synchronization project priorities 1 through 6, including “TDSP as LSE” clean-up and DART/QRE defined issues, must be 95% complete by all Market Participants based upon Market Sync Reporting Tool . • Outstanding QRE issues documented by ERCOT as of 12/16/02 be 95% complete. (“In Progress” and “In Analysis” as reported to RMS 12-18-2002) • ERCOT will have in place a mechanism for daily monitoring and synchronization of ERCOT’s Siebel and Lodestar systems. • ERCOT’s Siebel related data issues will be monitored and brought to a point of being repaired daily.

Progress toward completion criteria will be reviewed at each RMS meeting. • Market Issues • CRs do not know which ESI IDs are settled on estimated vs. actual usage, because settlement data is at the aggregated load profile level within the QSE. • CRs lack visibility to ESI ID characteristic information as it is contained in ERCOT systems and therefore are unable to reconcile against aggregate settlement data. • QSEs/REPs do not know which ESI Ids are included in their aggregated load profiles for settlement. • After True-up statements have been issued, QSEs/CRs can only dispute changes between Final Settlement and True-up. They lack the data on which to base their dispute at Final Settlement.

RMS places a High-High project approval/priority to SCR 727. • Issues/Solutions • SCR 727 requests a data extract of ESI ID information to enable CRs and TDSPs to know the time periods for CR relationships, ESI ID characteristics and the usage records used for data aggregation and settlement. • RMS places a HIGH – HIGH priority because this data allows a CR visibility into ERCOT systems for ESI ID level detail information thus supporting reconciliation of aggregate settlement information and settlement statements. This also allows the CR to reconcile ESI ID level discrepancies with ERCOT prior to final or true-up settlement which reduces the number of potential disputes and aids in increasing the integrity of settlements overall.

Continuation #1 • Upon TAC approval, suspend further True-up settlements for 2002. • True-up resettlement (starting with January 1, 2002) will commence April 1,2003 orupon completion of the criteria below; whichever occurs first. Any discrepancies after the deadline must be accepted by all parties. Progress toward completion criteria will be reviewed at each RMS meeting. • Develop functionality and provide data extract as defined in SCR 727. RMS places a High-High project approval/priority to SCR 727. • Issues/Solutions • When drafting this resolution, ERCOT could not provide RMS with a goodprojected completion date for SCR 727. The resolution therefore includes the stipulation that “progress toward completion criteria will be reviewed at each RMS meeting” with the idea that the April 1, 2003 date could have to be adjusted depending on the estimated completion date of this critical item.

Progress toward completion criteria will be reviewed at each RMS meeting. • Market Synchronization project priorities 1 through 6, including “TDSP as LSE” clean-up and DART/QRE defined issues, must be 95% complete by all Market Participants based upon Market Sync Reporting Tool . • Issues/Solutions • Market Sync issues deal with CR ownership of ESI IDs crossing 04-01-2002 through 08-11-2002. Any relationship corrections happening after a True-up settlement would not be reflected financially since no other settlement of the trade day is scheduled. • Market Syn project still has around 240,000 ESI IDs to resolve. Targeting 95% complete places a reasonable and obtainable goal upon Market Participants to complete this initial Market Syn effort.

Progress toward completion criteria will be reviewed at each RMS meeting. • Outstanding QRE issues documented by ERCOT as of 12/16/02 be 95% complete. “In Progress” and “In Analysis” as reported to RMS 12-18-2002 which total 33,369. • Issues/Solutions • Outstanding QRE requests can impact ownership, Start & Stop dates of that ownership, consumption data, etc that impacts the data integrity of the settlement statements. Majority of the outstanding QREs are assigned to TDSPsfor research and probably requires them to repair transactions/data. • Targeting 95% complete places a reasonable and obtainable goal upon Market Participants to complete QRE research and necessary repairs effort.

Resettlement Issues and Solutions • Upon TAC approval, suspend further True-up settlements for 2002 . • True-up resettlement (starting with January 1, 2002) will commence April 1,2003 or upon completion of the criteria below; whichever occurs first. Any discrepancies after the deadline must be accepted by all parties. Progress toward completion criteria will be reviewed at each RMS meeting. • ERCOT will have in place a mechanism for daily monitoring and synchronization of ERCOT’s Siebel and Lodestar systems. • ERCOT’s Siebel related data issues will be monitored and brought to a point of being repaired daily. • Issues/Solutions • ERCOT’s Siebel to Lodestar interfaces periodically produce errors which must be reconciled. Previously this had been accomplished on an ad-hoc basis but needs to move to a daily process with specific ownership. • There are currently system and process upgrades planned and underway to correct and manage Siebel ESI ID related data issues. Until these upgrades are completed and migratedto production, ERCOT will continue to query for inconsistencies and problems then take corrective actions. These situations have been handled on an ad-hoc basis but needs to move to a daily process with specific ownership.

Progress toward completion criteria will be reviewed at each RMS meeting. • Issues/Solutions • RMS felt like all issues dealt with in the resolution were important to the • fairness of the market. • RMS thought percentages specified for completion on each issue were reasonable. • RMS also thought that an end date needed to be specified rather than leaving • the resolution open ended. • However, RMS inserted the item above in case significant progress was not being • made toward the specified percentages, or in case prioritization of SCR 727 did • not allow for timely completion, with the idea that the time frame for commencing • True-ups and Resettlements could be delayed if necessary.
