  1. Memorandum of Association Attestation The charter of a corporation is represented by a Memorandum of Association Attestation (MoA). It is a legal document written during a company's creation and registration process that defines the company's relationship with its shareholders and states the company's goals. The attestation of the memorandum of association attestation is a public document that can be accessed at Companies House. A copy of the memorandum must be kept at each company's registered office or SAIL address. The memorandum of association establishes the firm, whereas the articles of association specify how it will be administered, governed, and owned. The Memorandum of association comprises the company's name, registration office, primary and secondary objects, members' liabilities, and allowed capital. The main purpose of the memorandum of association is to limit the scope of activities and powers of the company. There are specific kinds of persons (natural or artificial) who can subscribe to the memorandum. These are: 1. Individuals - The memorandum can be signed by an individual or a group of individuals. 2. Foreign citizens and non-resident Indians — Rule 13(5) of the Companies (Incorporation) Rules specifies that a foreign citizen must have his signature, address, and proof of identification notarized to subscribe to a business in India.

  2. The foreign national must have visited India previously and be in possession of a valid business visa. The photograph, address, and identification proof of a Non-Resident Indian should be attested at the Embassy using a certified copy of a passport. There is no need to obtain a business visa. 1. Minor - A minor can only be a subscriber if his guardian is also a subscriber. 2. Corporation formed under the Companies Act - The company can sign the memorandum as a subscriber. Any other individual allowed by the board of resolution, including a director, officer, or employee of the company. 3.
