DATA LINK SUMMARY OF ACTIVITIES (II)  FRSG (Activities) New draft proposal JAR-OPS 1.728 (presented to OST September 2003, FRSG WP 03-05 and to OST in November 2004, FRSG 04-1):1)Aeroplanes first type certificated on or after 1 January 2008shall be equipped with flight recorder which shall record those digital communication applications listed on table A of Appendix 1 to JAR-OPS 1.728 2) From 1 January 2010, aeroplanes first type certificated before 1 January 2008 and first issued with an individual certificate of airworthiness on or after 1 January 2010 shall be equipped with flight recorder which shall record those digital communication applications listed on table A of Appendix 1 to JAR-OPS 1.728 that are capable to being used.3) From 1 January 2012, aeroplanes which are modified to introduce any new or additional digital communication application type(s) listed within Table B of Appendix 1 to JAR-OPS 1.728 The retrofit into in-service aircraft was not addressed.Consideration of the different type of digital communication applications, very wide domain of messages. Some data link communications messages are not uniform or not yet defined. FRSG proposed draft letter to be sent to ICAO by JAA Members States to re-open the discussionNot Regulatory Impact Assessment was developed. DATA LINK SUMMARY OF ACTIVITIES (III) • EUROCONTROL (Position and Proposal)Presentation by Steve Zerkowitz to OST 04-3:1)All aeroplanes for which the individual certificate of airworthiness is first issued after January 2010, which utilize data link communications and are required to carry a cockpit voice recorder, shall record on a flight recorder, all data link communication..2) The requirement for recording of digital communications on all other aircraft is not applied at least until 2015, New draft proposal by Steve Zerkowitz for OST 05-3 (this proposal has not been discussed with the FRSG yet): 1)Aeroplanes first type certificated on or after 1 January 2008 shall be equipped with flight data recorder which shall recorder the digital communications applications 2) From 1 January 2010, the aeroplanes first type certificated before 1 January 2008 and first issued with an individual certificate of airworthiness on or after 1 January 2010shall be equipped with flight data recorder which shall recorder those digital communications applications.3) All other aeroplanes are exempted from the requirement to record digital communications. No regulatory impact assessment has been provided. Draft letter to be sent to ICAO by JAA Member States. DATA LINK SUMMARY OF ACTIVITIES (IV) • AEA (Position) AEA presentation to OST 05-1, by Vincent De Vroey: AEA has consistently opposed the ICAO Annex 6 retroactive data link recording standard.  AEA requested JAA Member States to file a different from the retroactive ICAO annex 6 data link recording standards. AEA encouraged the JAA Members States to coordinate with the FAA to approach ICAO to file a difference to some extent. Economic impact resulting from Digital communications Recording amendment to ICAO Annex 6 put an unacceptable burden on the operators and no regulatory impact assessment has been performed. CURRENT SITUATION • Mr. Luca Falessi had to resign from the FRSG Chairmanship • No replacement has been provided to cover this vacancy • Therefore, the progress of this work has been put on hold • EQSG chairman tried to find focal point between the FRSG members without success. • EUROCONTROL proposal need to be coordinate with FRSG CJAA OPS DIV

  8. COORDINATION WITH EASA. ETSOs FOR RECORDERS  EASA has issued a NPA included the existing modified ETSOs and new ETSOs with a revised reference to EUROCAE ED 112. This NPA is being published in the coming week.ETSOs have been harmonized with FAA TSOs. CJAA OPS DIV

CJAA OPS DIV PROPOSAL • Set up an Ad Hoc Working Group • Specific Terms of Reference: develop a Regulatory Impact Assessment of the proposed activities. • Goal: to produce a developed justification (RIA) to present to ICAO to re-open discussions. • Coordination needed with FRSG (EQSG), EUROCONTROL and FAA. • Limited time frame to complete the task. • Collaboration and coordination of JAA Members States is needed CJAA OPS DIV
