  7. Challenges cont Occupational Health and Safety There are state and federal OH&S laws that need to be observed ensuring the health, safety and wellbeing of staff. This may require: • pre-employment health assessments; • monitoring, modification of the workplace; and • the provision of personal protective equipment. Challenges cont Conditions The Higher Education sector along with other employers are subject to: • Workplace Relations Act 1996 and State or Territory Legislation that governs terms and conditions of employment. • Awards that are established by independent tribunals that govern terms and conditions of employment across an industry. • Enterprise Agreements that are negotiated between the employer and their staff that governs employment terms and conditions at the workplace. • Contracts of employment that are negotiated directly between the employer and the employee that governs the terms and conditions of employment. • Employer’s policy also govern working conditions.
