Highway and Motor Carrier Highway Transportation regulations required under Public Law P.L. 110-53, HR 1, “9/11 Implementation Act” signed August 3, 2007 • Rulemakings required: • Security Sensitive Hazardous Materials (Sec. 1501) • Over-the-Road Bus (OTRB) Operators to complete vulnerability assessments and have approved security plans (Sec. 1531) • Develop Exercise Program for OTRB Operators (Sec. 1533) • OTRB Training Program (Sec. 1534) • TSA is also required to develop a program regarding Motor Carrier Shipment Tracking of Security-Sensitive Materials (Sec. 1554)

Highway & Motor Carrier Security Sensitive Hazardous Materials (P.L. 110-53, Sec. 1501) • “Security sensitive materials” means a material, or a group or class of material, in a particular amount and form the Secretary, in conjunction with the Secretary of Transportation, determines, through a rulemaking, poses a significant risk to national security while being transported in commerce due to the potential use of the material in an act of terrorism. • TSA is in the process of drafting this NPRM

Highway & Motor Carrier Over-the-Road Bus (OTRB) Operators to complete vulnerability assessments and have approved security plans (P.L. 110-53, Sec. 1531) • Develop and issue regulations for a program requiring over-the-road bus operators to conduct vulnerability assessments and implement security plans. • TSA is currently drafting a combined NPRM with similar requirements with Mass Transit, Freight Rail and Highway and Motor Carrier

Highway & Motor Carrier Over-the-Road Bus Training Program (Sec. 1534) • Develop and issue regulations for an over-the-road bus training program to prepare frontline employees for potential security threats. • TSA is drafting a combined NPRM with similar requirements with Mass Transit, Freight Rail and Highway and Motor Carrier

Highway & Motor Carrier Develop Exercise Program for Over-the-Road Bus Operators (P.L. 110-53, Sec. 1533) • Establish a program for conducting security exercises for over-the-road bus operators • TSA has an operational exercise program, ISTEP, the Intermodal Security Training Exercise Program. • The Highway and Motor Carrier Division is currently scheduling 6 exercises/workshops through September 2009. Four are modal specific and two will be multi-modal. • April-motorcoach; May-hazmat trucking; June-multi modal; July-school transportation; August-infrastructure; September-multi modal.

  7. Highway & Motor Carrier Motor Carrier Shipment Tracking of Security-Sensitive Materials (Sec. 1554) • Develop a program to facilitate the tracking of motor carrier shipments of security-sensitive materials and to equip vehicles used in such shipments with technology to enable tracking. • TSA has completed developing the program and submitted the report to Congress. DHS is currently working on an operational pilot.

  8. Highway & Motor Carrier School Bus Transportation Security (Sec. 1538) and Truck Security Assessment (Sec. 1540) • TSA is required to complete risk and security assessment of the nations school bus transportation system and the trucking industry. • TSA is currently finalizing the school bus transportation risk assessment report and is working to complete the assessment process of the trucking industry.
