  3. STRATEGIC PLAN • The CGE is in its 4th year of the Strategic Plan. The Vision, Mission and values have remained the same. • The approved structure has been amended in that a moratorium is placed on vacant positions in Head Office due to a reduced budget. • New Commissioners have been appointed since the inception of the strategic plan. • An M&E approach is followed this year and a structure will be put in place to ensure governance.

CONSTITUTIONAL MANDATE & OBLIGATION Constitutional Mandate - S187(1) The Commission for gender equality must promote respect for gender equality and the protection, development and attainment of gender equality. Additional Powers and Functions prescribed by National legislation • S11 (1) of the CGE Act 39 of 1996 (As amended) Monitor Investigate Research Educate Lobby Advise Parliament and report on issues concerning gender equality Monitor compliance to Regional & International Conventions

Constitutional Mandate & Obligation continued • Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (PEPUDA) Assist complainants in instituting proceedings in the Equality Court Conduct investigations and make recommendations regarding persistent contraventions of PEPUDA The Bill of Rights in the Constitution enshrines the rights of all people to the democratic values of human dignity, equality and freedom. The CGE’s obligation to strengthen constitutional democracy is the attainment of gender equality.

VISION AND MISSION Vision • A society free from all forms of gender oppression and inequality Mission • Monitor, evaluate and make recommendations on policies of the public and private sector • Information and educational programmes • Evaluate and make recommendations on legislation affecting the status of women • Investigate, resolve and rectify gender issues • Collaborate with government and civil society • Monitor and report on international conventions

SECTION 6 COMMITTEES The Commission has further established one Section Six Committee that will focus on the following areas to inform programmes:- • Women’s Economic Empowerment • National gender machinery • Gender Equality and Health • Gender Based Violence • Culture, Religion and Tradition • Women’s substantive Equality

International Conventions, charters and Declarations informing the Commission’s Programmes Commitments made by the state to the implementation of CEDAW • Monitoring of implementation of CEDAW by state department • Producing monitoring reports which highlights achievements and challenges • Sharing recommendations with the state on improving compliance with the convention by engaging with the Minister of Women • Supporting the country in when reporting to the CEDAW Committee in 2015

International Conventions, charters and Declarations informing the Commission’s Programmes Commitments made by the state to the implementation of the Beijing Declaration Platform for Action and the Millennium Declarations and the MDGS • Monitoring the compliance of the implementation of the Beijing Declaration and the Platform for Action with focus on the 12 Critical areas of Concern • Monitoring compliance and tracking progress on the implementation of the MDGs • Producing monitoring reports which indicates achievements and challenges • Sharing recommendations with the state on improving compliance with the convention by engaging with the Minister of Women • Supporting the country in when reporting to the CSW in 2016 • Engaging with the post 2015 agenda which reflects on new development challenges- leading to the adoption of Sustainable Development Goals (SDGS)

South African Protocols informing the Commission’s Programmes Commitments made by the state to the implementation of the Maputo Protocol and the SADC Protocol on Gender and Development • Monitoring the compliance of the implementation of the Maputo Protocol • This is a new focus for the Commission and will be undertaken in 2015 Financial year • Will be monitoring compliance and tracking progress on the implementation of the Maputo Protocol • Tracking the implementation of the SADC Protocol. • This will be undertaken in this financial Monitoring South Africa’s compliance to achieving gender equality by producing a status report on gender equality • Producing a monitoring report on the status of gender equality in the country by implementing the Africa Gender and Development Index tool

Gender landscape influencing Commission’s programme • The embedded impact of patriarchy on institutions, relations and behaviours • Deepening inequality; poverty; lack of access to and ownership of land; unemployment and precarious employment. • The persistence of Gender Based Violence, including on the basis of sexual orientation and HIV/AIDS • Denial of reproductive and sexual health rights • Increasing traditional, cultural and religious fundamentalism • Decision-making power and substantive participation of women • Empowerment and the economic empowerment of women

Funding • CGE Funding remained at the same level for the previous 5 years. • Only increases made were mainly for inflation adjustments and additional funding requests were not responded to in a positive way. • For the financial year 2015/16, increases will not be made by the Fiscus, despite inflation, increased mandate and public expectation. • Further to the latter, the budget for 2015/16 has been reduced by 4%. • Current situation severely limits the CGE to deliver on its legislative mandate. • Redress of gender violations and advancement of rights spans to grassroot levels, requiring interventions with multiple approaches. Budget not adequate to sufficiently address this.

  20. Funding continued… • Current ITC systems are technologically absolute and physically worn out and impede on business operations. Baseline budget does not adequately finance the strategic plan. • Training for staff has been cut due to financial constraints. • Moratorium placed on filling of positions at Head Office, which impedes on productivity. • As a consequence of budget reduction of 4%, the CGE is forced to undertake austerity measures in the 2015/2016 financial year.
