SAFETEA-LU: PRISM Provisions • Section 4109(C)(3) – PRISM: Conditions for Participation • Secretary of Transportation shall require States to: • Comply with policies and procedures • Possess or seek authority to impose sanctions based on a Federal safety fitness determination • Establish and implement a process to cancel the motor vehicle registration and seize the registration plates of a vehicle when an employer is found liable under section 31310(i)(2)(C) for knowingly allowing or requiring an employee to operate such a commercial motor vehicle in violation of an out-of-service order

SAFETEA-LU: Possible PRISM Implications • Section 4114 – Intrastate Operations of Interstate Motor Carriers • Prohibited Transportation • Motor carriers prohibited from operating in interstate commerce may not operate any commercial motor vehicle that affects interstate commerce until the Secretary determines that such owner or operator is fit.

SAFETEA-LU: Possible PRISM Implications • Section 4114(C) – Determination of Unfitness by a State • If a State uses the Federal standards to determine an Intrastate motor carrier in their State is Unfit, the FMCSA shall prohibit the motor carrier from operating in Interstate commerce until the State determines the carrier is Fit.
