Maximum Length of Assignment Temporary workers, in a position, shall be provided to the requesting agency/department for a maximum 480 hours per position, as required. • State agencies should use the modified FTE process for temporary employment requiring longer terms. • If the Contractor exceeds the 480 maximum hours, per position, the State may terminate this contract. • Reporting. Contractor shall submit a report to the Contract Liaison, Hiring Agency Human Resources, and Hiring Manager when a worker reaches 360 hours worked.

PERS Retirees Working Through A Temp Service Agency (Ref. 19-3-1106 MCA) PERS retirees returning to work through a temporary services agency or as an independent contractor need to be reported to MPERA and employer contributions are owed for retirees under age 70.5. • Agency should contact MPERA at 844-304-5452 (444-3994 in Helena) to have a payroll schedule set-up (typically agency HR/Payroll staff). • The retiree will need to be enrolled in ERIC. • Payroll for the working retiree will need to be reported according to the payroll schedule set up.

  8. Cost Structure The State Agency and Contractor shall negotiate the hourly cost of the temporary worker before temporary worker is placed. This hourly rate will be the actual wage rate paid to the temporary worker. Contractor’s Management Service Fee (based on a percentage) includes all anticipated charges, including but not limited to, cost of materials and product, travel expenses, screening, transaction fees, overhead, profits, and other costs or expenses incidental to the Contractor’s performance. Contractor’s Management Service Fee is a not to exceed maximum percentage; however, the Contractor’s Management Service Fee may be negotiated to a lower percentage.
