SPECIAL EXCEPTION STANDARDS UNDER FLORIDA LAW • The applicant for the special exception request has the initial burden of demonstrating that his/her request is consistent with the comprehensive policy plan and meets the criteria for granting the special exception; and (2) If the applicant carries that initial burden, the burden shifts to those opposing the special exception to show by competent substantial evidence that the request is not consistent with the comprehensive policy plan and does not meet those criteria.

BACKGROUND CASE #: SE-09-05-013 APPLICANT: Orange County Public Schools, Evans 9th Grade Center REQUEST: To amend previous special exception for Evans 9th Grade Center to allow Orange County Public Schools to operate the 9th grade center as a high school with an enrollment not to exceed 2,250 students for a maximum of 3 years (October, 2012) ZONING: R-1A TRACT SIZE: 25 acres LOCATION: East side of Lake Stanley Road, ¼ mile north of Silver Star Road DISTRICT: #2

PROJECT DATA • July 3, 1991: Orange County approves 9th Grade Center for up to 1125 middle school students • 2008: BCC twice rejects the relocation of Evans HS to Clarcona Rural settlement area • This proposal is to relocate Evans HS students to 9th Grade Center for 3 yrs (October, 2012) while Evan’s High School is rebuilt at current site • If approved, 9th Grade Center will have up to 2250 students • After October 2012, HS students and the 9th Grade Center will move back to the new Evans High School • 58 portables will be needed to accommodate the new students • 9th Grade Center and proposed portables are outside the Clarcona Rural Settlement

PROJECT DATA • Access will remain off Lake Stanley Road • Most of the students will be bused to site • Parking is regulated by the State of Florida, not Orange County • All sports activities will remain at Evans High School • Practices for outdoor sports may occur at the 9th Grade Center • School hours will be 7:30 am – 5:00 pm • After October 2012, the high school students (grades 9 thru 12) will move back to the Evans High School Campus • There are no immediate plans for the Evans 9th Grade Center after Oct. 2012 • On April 20, 2009 the applicant conducted a community meeting

  19. BZA FINDINGS • The use is temporary • Using an existing school site is preferred in lieu of a non-school use site • The applicant sufficiently addressed the concerns • Approval of the request will be in the public’s best interests

  20. BZA RECOMMENDATION • Approval of the request in that it complies with Section 38-79 (Special Exception Criteria); said approval is subject to the 7 conditions • Unanimous

  21. BZA CONDITIONS Approval of the request subject to the following conditions: 1. After 3 years (October 31, 2012) approval for the site reverts back to 1125 middle school students as originally approved; 2. After 3 years (October 31, 2012) the additional 58 portable units shall be removed; 3. No nighttime sports at the 9th Grade Center 4. The site may be used for practices for outdoor sports; 5. Band activities may occur on the site during school hours; 6. The sidewalk along Silver Star Road shall be extended north to the southernmost driveway; and 7. Orange County Public Schools shall coordinate with Lynx for a new bus stop at the school’s entrance.

  22. BCC ACTION REQUESTED ACTION REQUESTED: Approve the request consistent with the Board of Zoning Adjustment’s recommendation with the conditions.
