  12. Priority Laws Private Investment Law Ownership : Two Types Either 100% ownership by Investors or joint venture between the Government of Afghanistan and Private Investors. Equal rights for investors whether local or foreign Customs relief : Provision for exemption from export charges on products manufactured or assembled in Afghanistan. Tax Concessions for Approved Enterprises Net Operating Loss can be taken forward to next financial year for suitable deduction from taxable income.

  13. Private Investment Law Employing experts of choice: No restrictions Right to lease immovable property: up to 50 years. Transfer of Foreign Investment Capital: Right to freely transfer out equivalent of investment in foreign currency upon payment of taxes due.

The Company law: Corporation Law; Limited Liability Company Law, Partnership Law Corporation Law: Shareholders reduced to 25 from 100 Limited Liability Company Law Partnership Law (introducing LLP and PPP), ACBR (Afghanistan Centre for Business Registration) No duplication of companies names under the Company and Trademark Registration Law (TRM) Possibility to register trademark under the TMR Law Business can now register, obtain a Tax Identification Number (TIN), publish their business name in the Gazette, pay one fee, and get a referral letter to any licensing agency (if needed) all in one central location.

Other Laws Contract Law: Law based on international best practice in Place Mediation and Arbitration Laws: ACDR (Afghanistan Centre for Dispute Resolution) being created for assisting Negotiation, Mediation, Arbitration. Competition Law A competition law drafted for promoting a competitive market structure. Covers all three areas of Anti-competitive practices Abuse of Dominance and Combinations.
