Notary Commissions • Granted by the MN Secretary of State* • Registered in the county of residence* *Minnesota notaries may live in bordering counties in Wisconsin, Iowa, South or North Dakota and register their commission in the Minnesota border county where they work per Statute 359.01 Subd. 2. These notaries commissions are approved by the Governor.
If you are a notary, then • You witness signatures • You attest to copies of documents • You administer oaths, oral and written HOWEVER… OSR policy does not include notary authenticated documents
Notaries should • Have integrity – check IDs, no shortcuts, maintain confidentiality • Be impartial – don’t notarize self or family members, or discriminate against others • Be trustworthy – the seal validates documents, so check for completeness before signing
If something is notarized then… You know: • The identity of the signer is verified • The signature is witnessed • The document is an original • The document is complete
Reviewing notarized documents • Make sure date of signature matches the date of notarization • Is the notary’s seal on the document? • Is it valid? • The form is complete with no white-outs or crossed out information
Witnessing documents at the counter • Examine the identity documents of the person at the counter • Verify the birth date on the ID matches the one on the application • Check for tangible interest – does he/she have the right to this? • The form is complete with no white-outs or crossed out information
A properly notarized document • Is NOT notarized by a family member • There is no question of Beneficial Interest
Parent Notices What if one parent notarizes the other parent’s signature on a Parent Notice? When is this okay?
Acceptable Identifications • Minnesota drivers’ license or state ID card • Instruction permit • Government issued work ID • US Passport – valid • Military ID – active or retired • Foreign passport WITH I-94 or I-551 • Canadian BC/naturalization and I-94
Other acceptable IDs • Employment authorization I-688 or I-766 • Permanent resident/resident alien I-551 or 1-151 • Re-entry/refugee travel document 1-327 or I-571 • Certificate of naturalization • Certificate of citizenship • US citizen ID card I-179 or 1-197 • Northern Mariana card I-873 • American Indian Card I-872 • Current DOD ID cards DD-1173 or DD-214 • Government Employee Photo ID • Current FAA pilot’s license
Identifying witness? • Yes, if you can identify someone who knows and will certify the identity of the signer, you can notarize the document But be careful Use good judgment – who will benefit from this document?
