  2. What Is It? • Ocean dumping is the disposal of waste into the sea. This act is very dangerous to oceanic wildlife and has been around for centuries. The overall effects of ocean dumping are hard hitting and destructive, the likes of which will take many years to overcome. The problem is that there seems to be no end in sight.

  3. Fixing the Problem • The motivation for banning ocean dumping gained momentum when contaminated wastes from sewage-derived microorganisms were discovered at public beaches, shellfish beds were contaminated with toxic metals, and fish were infected by lesion-causing parasites. Coastal areas continually impacted by nutrients in waste products (primarily nitrogen) that run off the land eventually suffer from increases in toxic algal blooms and decreased oxygen levels, both of which can kill fish populations. Currently, ocean dumping is generally banned worldwide.

  4. Ocean Dumping Ban Act • Makes it unlawful for any person to dump, or transport for the purpose of dumping, sewage sludge or industrial waste into ocean waters after December 31, 1991; • Prohibits, after the 270th day after enactment, any person from dumping, or transporting for the purpose of dumping, sewage sludge or industrial waste into ocean waters unless the person: (1) enters into a compliance or enforcement agreement (which includes a plan negotiated by the dumper, the State, and EPA for terminating dumping as well as a schedule which EPA believes will result in the termination of the dumping), and (2) obtains a permit issued by EPA under authority of sec. 102 of the Marine Protection, Research, and Sanctuaries Act (MPRSA); • Provides for the payment of special fees for dumping and any penalties incurred by a dumper to be deposited into certain funds for use in finding alternatives to ocean dumping.
