  3. - Why art 7(2) in the ERDF regulation 1080/2006 • Within the framework of urban development operations, it was considered necessary to support limited actions to renovate housing in areas experiencing or threatened by physical deterioration and social exclusion in Member States that acceded to the European Union on or after 1 May 2004 (EU12). • ERDF would contribute to housing expenditure related to provision of good quality accommodation for lower income groups and vulnerable social groups. • A number of Member States earmarked about € 900 M for investments in housing, on the basis of art 7(2) provisions, for the programming period 2007-2013.

Why amending art 7(2) • All available evidence shows that housing, constitutes a decisive factor of integration for marginalised communities, of which the vast majority are Roma. • The housing conditions in these communities is such that refurbishment is impossible. It is therefore necessary to permit funding for construction of new housing. • In many Member States, a high number of such marginalised communities live in rural areas and not only in urban ones. • Marginalisation does not concern only new Member States but is present all over the territory of the Union. • Housing interventions alone have proven to be inefficient both in terms of combating segregation and in promoting socio-economic integration.

What has been modified • ERDF art 7(2) • Geographic coverage: 27 MSs • Urban and rural areas • Housing refurbishment and replacement including the construction of new housing • In order to tackle marginalisation and exclusion, housing interventions for marginalised communities should take place within the framework of an integrated approach, which includes, in particular, actions in the fields of education, health, employment, anti-discrimination and security, as well as desegregation measures. • Implementing Regulation art 47 • Defines the conditions for eligible housing interventions in favour of marginalised communities in the context of an integrated approach, with particular regards to the desegregation measures. • 2 conditions: 1) use of the integrated approach (housing together with education, employment, etc); 2) promotion of spatial integration and prevention of segregation, isolation and exclusion.

What has been modified Guidelines on the implementation of Integrated Housing Interventions • Document not yet formally approved • Clarifications of the concepts of desegregation, integrated approach and marginalised communities for the purpose of implementing art.7 • Reminder that EU funding cannot benefit private property but only property owned by public authority or non-profit operator. • Reminder that the duration of such ownership cannot be modified for at least five years after the housing operation.

  7. The role of Member States and regions • Is essential in using art.7 as a core component of the future National Roma Inclusion Strategies • Learn on others experiences (e.g. the integral plan of Polígono Sur in Seville; IRIS of the Community Autonomous of Madrid; urban integration projects, rural integration projects, FRA study on housing, etc.); • Promote holistic plans of interventions in favour of Roma communities, in partnership with the main actors and involving different forms of funding (EC, national, local). The involvement of Roma communities since the beginning is essential; • Reinforce coordination between the different EU and national funds for the purpose of promoting and facilitating the implementation of the integrated approach in housing; • Exchange of experiences and good practices; • Avoid/exclude investing on Roma projects that reinforce spatial segregation, isolation, exclusion.
