Background RBMP authorisation and/or permits • What is a mixing zone? • Mixing Zone =part of the surface water body restricted to the proximity of the point of discharge within which concentration of one or more pollutantsexceed relevant EQS, provided that it does not affect the compliance of the rest of the water body with the EQS. • Purpose • option in the EQS Directive (Article 4) • if applied: conditions • approaches and methodologies applied to define such zones • measures taken with a view to reducing the extent of the mixing zone • restricted to the proximity of the point of discharge • proportionate SCG 5 - 6 May 2010

Timetable • November 2008Draft Mandate for a Guidance on MZidentification endorsed by WDs • March 2009 Principles of Tiered Approach agreed by WG E • October 2009 Release to WGE of draft and associated software + Discussion at WG E (7) • October 28th WG-E deadline to submit written comments • November 30th 2009 Revised draft released • December 1st 2009 Final testing phase commenced • January 31st 2010 Testing Phase completed • March 2010 Final Draft release to WG E (9) + WG-E Sign off • April 2010 Final draft despatched to SCG • May 5-6 th 2010 SCG endorsement • May 27-28th 2010 Water Directors endorsement • 29 September Adoption by Regulatory Committee of WFD SCG 5 - 6 May 2010

Principles • Harmonised approach that enables the Competent Authority to first establish where a mixing zone is required, secondto determine its size and acceptability using a “tiered approach” and scrutiny and third to identify the appropriate location of monitoring points • Competent Authority has pivotal role in process of designation and development of mixing zones • Tiered approach offers: • A risk-based and proportionate approach • A focused approach: devote time and effort where necessary and eliminate trivial or minor discharges from further consideration SCG 5 - 6 May 2010

Current Guidance Document • Prepared by Drafting Group on Mixing Zones • working under umbrella of Working Group E • Membership drawn from Member States and stakeholders representatives • The version presented today is the Final Draft(v18): • Results of the testing phase • Comments received during and after WG E (9) were accommodated  no open issues SCG 5 - 6 May 2010

Testing phase • Scope: To investigate whether the guidance and associated software met Member States’ needs and to identify gaps • Undertaken by Belgium, UK and Eurometaux • The Netherlands provided on-line Masterclasses on the Discharge Test software • Outcomes Positive aspects • Guidance seen as logical, easy to understand and very clear • Tiered approach very useful, flexible and facilitates the decision making process • The Discharge Test itself is strong, easy-to-use and operates on a commonly used platform, but may be too conservative in some cases SCG 5 - 6 May 2010

  9. Testing phase • Outcomes • The guidance was not thought to be sufficiently comprehensive for tidal waters • Some contradictions between tiers possible because Tier 1and 2 approaches may be too conservative and not suitable for use throughout Europe and for all cases SCG 5 - 6 May 2010

Future Work • Firstly it is proposed to organise only one workshop with a little number of participants to assist new users to make best use of this guidance (other similar workshops could be organised, if requested) • The idea has been flagged to Working Group E (9)and broadly support • Experts (drafting group) could provide guidance on both the tiered approach philosophy and also how to deal with particular problems by worked examples (Member States will be invited to submit potential case studies in advance) • Draft Agenda of the first workshop was submitted to SCG Contact points: John Batty (John.Batty@defra.gsi.gov.uk) Jorge Rodriguez Romero (Jorge.Rodriguez-romero@ec.europa.eu) Madalina David (madalina.david@ec.europa.eu) SCG 5 - 6 May 2010
