  2. MEETING - May 22, 2009 Participants: • BCRD: Tim Hamilton and Jim Keating • Applicant: Evan Robertson • Hailey: Don Keirn, Heather Dawson and Ned Williamson

ISSUES Ownership of Land and Water. • Either BCRD or Hailey could own. • Hailey expressed a desire to own water in earlier annexation meetings and P&Z recommended Hailey own golf course land or have some controlling interest. If Hailey owned land and BCRD managed the golf course, a lease would be required. • Time of Ownership. • Title to property could be transferred at several times.

  4. ISSUES Management of Golf Course. • Either BCRD or Hailey could manage. • Most likely either party would use a third party contractor to manage the golf course. • Control of Fees • Parties discussed a potential joint powers agreement between BCRD and Hailey to review and establish fees, with the goal of establishing affordable fees and making golf course financially viable. Parties will consider necessary components of a joint powers agreement.

  5. ISSUES Consideration • If BCRD managed the golf course, Hailey could receive a percentage of gross or net revenues. • Capital reserves should be considered. • BCRD will research potential percentages and report back.

  6. Process Discussion Ordinance 889 Section 14.01.090 Findings. During the public hearing process of the application for annexation, the Council shall make its own findings of fact and conclusions of law to determine: 1) whether the proposed application will be harmonious and in accordance with specific goals and policies of applicable components of the Hailey Comprehensive Plan, and 2) whether the proposed annexation generally complies with the Hailey Comprehensive Plan, and to the extent possible, whether the proposed annexation will have a negative fiscal impact upon the existing citizens of Hailey at the time of an annexation and in the future.
