  4. Rumors Vs. Facts Trainees may have heard from management that the Union can’t do anything to help or assist them in representation. That is not True. While the Union may not be able to help trainees to keep their jobs if terminated because they don’t pass probationary period (fail immigration, Spanish tests or FTO program.), there are several other ways the Union can assist you…

  5. Liabilities Three types of liabilities that agents can face during their duties are: • Administrative • Civil Lawsuits • Criminal (complaints, investigations, • and possible criminal prosecution)

  6. What is Administrative? • Memorandums • Administrative investigation • IA interviews • Grievances • Proposed discipline (suspension, termination not for trainees, etc.)

  7. What is Civil Liability? A person or entity files a civil suit in court and notes the agent as the defendant. In Civil Cases US Attorney (Agency) may decline to represent the agent based on the facts if not in their best interests.

  8. What is Criminal Liability? • When acting in the course in scope of duties and results in criminal charges being filed against the agent. • Criminal Investigation • Criminal Prosecution (Agents in Texas as example)

  9. The Union Network • Union has networked w/other Sectors (locals) and created and extensive Legal Services Coverage for the Agents. • Gattey & Baranic LLP • GB LLP • These firms handle Legal Representation for SD, ELC, Yuma & Tucson Sectors.

Union Network Cont. • PORAC covers: • Civil (if U.S attorney decline to represent the agent) • Criminal Cases (where the allegation stem from duties that are within course and scope of job. • Critical Incidents (24 Hrs/day, 7 days a week as union member) • Critical Incidents (OIS, Vehicle Pursuit, AD, etc.)

  11. Administrative Liability Gattey & Baranic and Union handle the cases. Administrative Interviews (OIG, OIA, OPR, Sector Investigative Teams) Memorandums, discipline appeals, grievances, contract violations, etc

  12. The Reality... Chances are at some time in your career with the Agency you will be involved in and incident or be witness or subject to an incident which may result in discipline , administrative investigation, critical incident or maybe civil/criminal lawsuit.

  13. Continuation In the situations mentioned Legal Coverage offered by the Union is invaluable b/c attorney are not cheap. Legal Services plan like insurance, pay for it with Union Dues but hope you never need it.
