  2. American Legacy Foundation • A national, independent, 501(c)(3), public health organization • Established in March 1999 as a result of the Master Settlement Agreement (MSA) between a coalition of attorneys general in 46 states and five U.S. territories and the tobacco industry

  5. What is Clause 12? 12. Refusal of Funds From Tobacco-Related Entities The Grantee agrees that it shall not accept any grant or anything else of value from any tobacco manufacturer, distributor, or other tobacco-related entity.

  6. Purposes of Clause 12 1.Assure no conflicts of interest, potential conflict of interest or perceived conflicts of interest 2. Take on the efforts of the tobacco industry to achieve respectability and influence

  7. Limitations on Application of Clause 12 • Grants to entities that participate in the sale of tobacco products • Application to organizational units vs. the organization as a whole • Commitments regarding disclose of receipt of tobacco funds

  9. Nature of the Products • Nicotine is a drug, one of the most addictive • Tobacco use kills more people in this country each year than alcohol, illicit drugs, automobile accidents, violent crime and AIDS combined • Tobacco is deadly in its normal and intended use, to smokers and non-smokers

  11. Academic Institutions Academic Opposition: • Restrictions impinge on academic freedom and on institutional autonomy • Funders, whatever their goals, should not be able to affect research that is not aided by their funds

  12. Tobacco Funding of Academic Research Tobacco industry funding of research is not for the pursuit of truth and knowledge but an overall public relations strategy to reposition the tobacco industry, in the eyes of opinion leaders and the general public, as good corporate citizens
