For a successful immigrant visa application, an EB-5 investor must provide the proper documentation and be able to answer all the questions in his visa interview with the U.S. Embassy or Consulate in his home country.   1. PREPARING FOR YOUR EB-5 VISA INTERVIEW

  2. Once United States Citizenship and Immigration Services (USCIS) approved an I-526 petition, the EB-5 investor and his immediate family, his spouse and children below 21 years old, can start with their application for   immigration visas.

  3. The EB-5 investor will submit Form DS-260 to the U.S. Embassy or Consulate in his home country. The U.S. National Visa Center will review the application and notify the investor, and his family, about their interview date and documents they need to bring.

  5. Documents to Prepare for the EB-5 Visa Interview

  6. Birth Certificate Marriage Certificate Police Certificates Passport, must be valid for until at least 6 months after date of intended entry to the U.S. Divorce Decrees Passport photo, colored Sealed medical examination results Copy of submitted Form DS-260

  7. Aside from the documents mentioned, another needed document is an evidence that the capital amount has been released from escrow and used in an EB-5 project. You can obtain the documentation for this from the financial institution that manages the escrow amount for the project.

  8. Some reasons an applicant is denied an immigrant visa can be: prior illegal entry into the United States criminal history falsification of material facts in the submitted Form DS-260

Below are some of the things that might be asked during the interview: applicant's past, especially those that might be considered as red flags prior visits in the United StatesI -526 petition filed NCE (new commercial enterprise) the applicant invested in capital source used for the EB-5 investment

  10. Proper documentation will not solely determine the success of the EB-5 visa application process. An EB-5 visa applicant should also be prepared for the interview process. It is advisable to consult a qualified EB-5 professional who can guide the investor and his family throughout the whole immigrant visa process, especially the application and interview.

  11. Reminder: Arrive early on the day of your immigrant visa interview. Also, make sure that you have all the necessary documents. An interview with the U.S. Embassy or Consulate usually takes 30 to 45 minutes.
