US District Court Judge Tauro Ruling against DOMA “This court has determined that it is clearly within the authority of the Commonwealth to recognize same-sex marriages among its residents, and to afford those individuals in same-sex marriages any benefits, rights, and privileges to which they are entitled by virtue of their marital status.” “The federal government, by enacting and enforcing DOMA, plainly encroaches upon the firmly entrenched province of the state, and, in doing so, offends the Tenth Amendment. For that reason, the statute is invalid.”

  3. California Proposition 8 • A simple measure of two sections: • Section I. Title This measure shall be known and may be cited as the “California Marriage Protection Act.” • Section II. Article I. Section 7.5 is added to the California Constitution, to read: Sec. 7.5. Only marriage between a man and a woman is valid or recognized in California. • Passed by majority vote on Nov 5, 2008 • The vote overturned previous May 15, 2008 ruling by California Supreme Court that same-sex marriages were protected by the State Constitution

  4. Post-Passage Events The amendment was challenged; State Supreme Court upheld. Enactment of Prop 8 was also challenged with regard to the Federal Constitution. On August 4, 2010 U.S. District Court Judge Vaughn Walker ruled that Prop 8 was unconstitutional and issues an injunction against it. This marked the first time a federal court examined whether the U.S. Constitution allows states to outlaw same-sex marriage.
