  3. Eligibility Criteria Early Start, Part CandLEA from 5 CCR

  4. Early Start – Part C Birth to 24 Months Developmental delay with a 33% delay in one or more areas of development at the time of referral. After 24 Months Developmental delay with 50% delay in one area of development or 33% delay in two or more areas of development; or Established risk with a high probability of resulting in delayed development.

  5. LEA – 5 CCR • Child has a disability per 5 CCR 3030 as determined by the IFSP team and • The child is functioning at or below 50% of his or her chronological age level in any one of the following skill areas: 1. gross or fine motor development; 2. receptive or expressive language development; 3. social or emotional development; 4. cognitive development; and 5. visual development. (B) The child is functioning between 51% and 75% of his or her chronological age level in any two of the skill areas (25% in two areas) (C) The child has a disabling medical condition or congenital syndrome which the Individualized Education Program Team determines has a high predictability of requiring intensive speical education and services.

Required Services • Assistive Technology • Durable Medical Equipment • Audiology • Health Services, Nursing Services and Medical Services • Only for Diagnostic or evaluation • Nutrition Services • Occupational Therapy • Physical Therapy • Speech Therapy • Psychological Services Service Coordination • Family Training • Special Instruction • Behavior Therapy • Interpreter • Translator • Transportation • Vision Services • Other services may, in special circumstances, be required when those services are necessary to enable the child to receive early intervention services

  9. 3031. Additional Eligibility Criteria for Individuals with Exceptional Needs - Age Birth to Three Years. (B) A significant difference is defined as a 33-percent delay in one developmental area before 24 months of age, or, at 24 months of age or older, either a delay of 50 percent in one developmental area or a 33-percent delay in two or more developmental areas.

  16. Single Point of Entry • All infants and toddlers potentially eligible for any regional center program will enter at the regional center to determine eligibility for services. • LEA’s Providing Initial Assessment

Infant Units • Units initially awarded to programs with 80-81 mandate (30 EC 56425) • Additional Units awarded in program expansion in 1985-87 • Each LEA has a unique set of rates based on costs in 1980-81 • COLAs have been awarded overtime • Rates were boosted following AB 602 to make up for lack of access to excess property tax revenue.

  20. Growth and Recapture • Growth standard is in the Budget Act • SDC – 16 per unit • DIS – 16 per unit • RSP – 24 per unit • Recapture standard is in code (30 EC 56432(b)) • SDC – 12 per unit • DIS – 12 per unit • RSP – 24 per unit • Superintendent can grant waivers under certain circumstances

  22. Other stuff to know • Program is 200 days - no extended year funding (Budget Act - Provision 8 of Item 6110-161-0001) • There are no subcaps - all units can be SDC2 • Be careful in shifting units

Federal Part C • Established as a result of the California Early Intervention Services Act (CEISA) • Federal Part C funds flow to the Department of Developmental Services (DDS) lead agency • Amount for CDE determined through annual Budget Act • Purpose of funds is to address the required and supplemental costs of implementing Part C • CEISA contains termination provision

Base and Increased SLI • Total SLI projected in 1993-94 • Base number established in study in 1995-96 • Basic services for “Base SLI” is part of Infant Unit funding • For programs with units, total population to be served is the sum of (units x recapture standard)+(increased SLI) • Moving from use of projected number to actual SLI reported in CASEMIS

State Part C Grants • Originally established as a part of funding model change in 1995-96 Budget Act • Allowed to use excess general fund if: • Federal Part C fund fully expended • Serve more infants and toddlers with SLI than funded to serve • Originally a one time item, but remained in Budget Act • Allocated to SELPAs who: • Meet Budget Act eligibility • Have excess required and supplemental costs • Allocated in Spring can be used through September 30.

  36. Potentially Eligible - Definition • All Early Start children are deemed “potentially eligible” for special education and related services at age three. • Does NOT include children served under the Regional Center’s Prevention Program .

  37. Opt Out • OSEP requires states to address Opt Out policies regarding referral form Part C to Part B • DDS and CDE under discussion

Notification • At two years six months (“shortly reaching age of eligibility”) • List sent to children’s district of residence • And again no later than two years nine months • All children deemed “potentially eligible” • Sent to child’s district of residence -specific information • Late referrals
