Definition and Purpose • Seriously deficient (SD) means the status of an institution or a day care home that has been determined to be non-compliant in one or more aspects of its operation of the Program [7 CFR §226.2] • SD Process is designed to assist with: • Identifying frequent or severe program noncompliance • Requesting written corrective action • Preventing recurring noncompliance • Offer due process for proposed termination and disqualification

Definition and Purpose The Serious Deficiency Process is: • A tool to identify and address frequent and severe noncompliance; • A process to offer targeted training and technical assistance to the institution; • A guide to ensuring corrective action when noncompliance is discovered; • A way to assist institutions with the development of corrective action that permanently resolves the deficiency; • A process that may prevent termination and disqualification from the program.   6. Steps of the Serious Deficiency Process Upheld – Notice of Final Termination and Disqualification OR Overturned – Notice of Temporary Deferment If requested, hold an Appeal Accept the CAP – Notice of Temporary Deferment OR Deny the CAP – Notice of Proposed Termination and Disqualification

  7. Identify the Serious Deficiencies The following are noncompliance issues that rise to the level of a serious deficiency [7 CFR 226.16(l)(2)]: 1. Submission of false information on the institution’s application; 2. Submission of false claims for reimbursement; 3. Simultaneous participation under more than one sponsor; 4. Non-compliance with the Program meal pattern; 5. Failure to keep required records; 6. Conduct or conditions that threaten the health or safety of a child(ren) in care, or the public health or safety; 7. A determination that the provider has been convicted of any activity that occurred during the past seven years and that indicated a lack of business integrity. This list should not be considered to be all-inclusive.

Identify the Serious Deficiencies Responsible Principals and Individuals • Responsible Principal:compensated or uncompensated, who the State Agency determines to be responsible for an institution's serious deficiency; • Responsible Individual: any other individual employed by, or under contract with, a provider, who the State Agency determines to be responsible for the serious deficiency [7 CFR §226.2]. • Evaluate the degree of responsibility • Assigned CACFP duties • Lack of business integrity • Owner or employee • Oversight

Notice of Serious Deficiency • Notice must include: • The serious deficiencies (findings), including appropriate citations from the CACFP regulations; • The actions to be taken by the institution to correct the serious deficiencies; • The allotted time to correct the serious deficiencies; • That the serious deficiency determination is not subject to administrative review (appeal); • That failure to fully and permanently correct the serious deficiencies within the allotted timeframe will result in the issuance of a Notice of Proposed Termination and Disqualification of the Institution’s agreement and disqualification of the Institution and all Responsible Principals and Responsible Individuals; and • That the Institution’s voluntary termination of its agreement after being notified of the serious deficiency determination will still result in the formal termination by the State Agency and placement of the Institution and all Responsible Principals and Responsible Individuals on the NDL [7 CFR 226.16(l)(3)].

  11. Activity: Five “Whys?”

  12. Five “Whys?” Finding: On the day of review, for PM snack, infants were served formula/breastmilk and blueberry muffins, but no fruit or veggie. The menu listed pears. • Why was there a missing component? Because the kitchen staff did not send a fruit/veggie to the infant classrooms. • Why did the kitchen staff not send the missing component? Because they thought the blueberries in the muffins were considered a serving of fruit. • Why did the kitchen staff think that the blueberries in the muffins were to be counted toward the fruit serving? Because they had not been properly trained. • Why wasn’t the kitchen staff properly trained? Because the primary CACFP contact failed to train them. • Why did the contact fail to train them? Because she was retiring from the Center. Root cause: Lack of adequate oversight (training requirements).

  13. Five “Whys?” During the Administrative Review, the institution submitted attendance and point-of-service documentation for the test month. On several days during the month, the teacher in the toddler classroom recorded meals that exceeded the number of children marked “present.” During the Administrative Review, the institution submitted the Master Enrollment List (MEL) for the test month. The MEL included participants who had terminated from the Center several months prior to the test month. These participants’ reimbursement categories were included in the counts reported to the State Agency on the claim for reimbursement. During the Administrative Review, the institution did not have itemized receipts and/or dated invoices for CACFP-related expenses (food and non-food supplies, and administrative supplies) for the test month. The primary CACFP contact and the Food Service Manager are responsible for filing the receipts and invoices. The Owner is responsible for tracking CACFP costs and reconciling them against the monthly reimbursement.

  14. Corrective Action Request The deadline for ALL corrective action responses and implementation must not exceed 30 days.
