  2. What is “evidence?” “…testimony, writings, material objects, or other things presented to the senses that are offered to prove the existence or nonexistence of a fact.” Evidence Code 2 5/17/00

  3. Direct Directly proves a fact, without an inference or presumption and which in itself, if true, conclusively establishes that fact. • Circumstantial Pertinent items surround the circumstances of the crime. Types of Evidence 3 5/17/00
