VARIANCE REQUEST Purpose: Initiated as the result of needed additional right-of-way essential for the widening of Palm Coast Parkway and Old Kings Road in the immediate vicinity of the subject property. Alternatives: 1. Acquire needed right at this time via dedication opportunity; No cost to taxpayers Enables opportunity to enhance remaining landscape buffer 2. Acquire at later date via condemnation (eminent domain) Direct cost to taxpayers/timely process Remaining landscape buffer unaffected NOTE: • Need for additional right of way not restricted solely to the property in question. • Roadway widening in City’s 5-year Capital Improvements Program Status - Planning and Engineering – Active/construction 2013-2014 Additional Note: Technical site plan able to proceed with or without approval of variance request.

  3. VARIANCE STANDARD SUMMARY • Building setback – • Reduce building setback on Palm Coast Parkway from the required 25 ft. to minimum 12.5 ft. (Variance 12.5 ft.) • Reduce building setback on corner of Palm Coast Parkway and Old Kings Rd. from the required 25 ft. to 19.9 ft. (Variance 5.1 ft) • Reduce monument sign setback from the required 10 ft. to 5 ft (Variance 5 ft.) • Landscape buffer – - Reduce landscape buffer on a portion of Palm Coast Parkway from the required 25 ft. to 12.5 ft (Variance 12.5 ft.). **affected buffer segment measures 60+/- linear feet on Palm Coast Parkway and 25+/- linear feet on the corner (diagonal portion) of Old Kings Road and Palm Coast Parkway; no affect Old Kings Rd segment.

  10. LANDSCAPE/SETBACK BUFFER ANALYSIS Minimum Required Buffer - 25 ft. Lot Area – 57,984 7,589 sq. ft. = 13.09% @ 12% maximum permitted reduction could reduce to 6,958 sq. ft. Buffer Provided Lot Area – 57,984 7,590 sq. ft. = 13.09% lot area @ 12.5 ft. minimum landscape buffer setback 25 ft. Buffer/Setback Line Restated Property Line Buffer Area • NOTE: • Ordinance 2000-23, in effect at the time of site plan application, required a 35 ft. Landscape Buffer/bldg. setback which the applicant was in compliance. Subsection 5.01.04 Landscape Development Standards;(4) 3(a) Limitation– If the area of the required front perimeter landscape area exceeds 12% of the total area of the lot, then the applicant may reduce the required front perimeter setback area to not more than 12% of the total area so long as the average width is never less than 25 feet.

  12. VARIANCE REQUEST Summary: City Initiated variance to accommodate needed additional right-of-way essential for the widening of Palm Coast Parkway and Old Kings Road. Technical site plan able to proceed with or without approval of variance request. Opportunity to Acquire needed right at this time via dedication opportunity; No cost to taxpayers; Opportunity to enhance remaining landscape buffer. Recommended Action: Approve the request for variance for setbacks and reduction in landscape buffer for ABC Fine Wine and Spirits.
