General Considerations • ICAR: Idaho Court Administrative Rules. http://www.isc.idaho.gov/rules/icaridx.htm • The objective of these rules (37 and 38) is to establish minimum standards for preservation, destruction or disposition of court records. • ICAR 37 deals with civil cases. • ICAR 38 deals with criminal and juvenile cases.

  3. I.C.A.R. 37 • Letter (a): general standards for retention. • Letter (b): preservation and destruction of records. • Letter (c): notice to the Historical Society. • Letter (d): sealed records.

  4. I.C.A.R. 38 • Letter (a): general standards for retention. • Letter (b): exception for people incarcerated, on probation, parole or rehabilitation program. • Letter (c): Deals with exhibits for people sentenced to life or death.

  5. I.C.A.R. 38 (continued) • Letter (d): preservation and destruction of records. • Recordings • Letter (e): Notice to the Historical Society. • Letter (f): sealed records. • A note on paid and dismissed citations.
