A BRIEF HISTORY • National Property Maintenance Code adopted by ordinance for over 20 years. • Previous enforcement by complaint only. • Summer of 2000 residents began complaining to City Council about property maintenance concerns. • Autumn of 2000 the Building and Planning Department created a policy and procedure manual for proactive enforcement of the property maintenance code.

  3. Authority Sections from Chapter 1 • 104.2 Rule-making authority: to adopt and promulgate rules and procedures; to interpret and implement the provisions of this code; to secure the intent thereof; and to designate requirements applicable because of local climatic or other conditions. • 104.4 Right of entry: the code official is authorized to enter the structure or premises at reasonable times to inspect. . .if entry is refused the code official is authorized to pursue recourse as provided by law.

  4. Property Maintenance Enforcement By the Book • Local adoption of a Model Code. • Create a policy and procedure manual and have this ratified by the legislative authority. • Establish an appeals board in accordance with Section 111, Means of Appeal. • Encourage or require inspectors to obtain professional certification. • Enforce the code equally and consistently to avoid charges of selective enforcement.
