Excusal of IEP Team Members • IDEA 04 provides the possibility that certain IEP team members might be excused from attending the IEP meeting. • Intent – provide flexibility to parents in scheduling IEP team meetings & to avoid delays in holding meetings when a team member cannot attend due to a scheduling conflict. • Parent and District must agreein writingprior tomeeting. • Does not apply toInitial Staffingor Initial IEP or Annuals. • Applies to required members – Does not apply to LEA. Ex. consent not needed to excuse an IEP team member with special knowledge or expertise attending by invitation of either party – since they are not required members.

Excusal of IEP Team Members IDEA 04 does not specify how far in advance of the meeting a parent must be notified of the District’s request to excuse a member… - ideally provide as much notice as possible and have the agreement signed at a reasonable time prior to the meeting. - Neither IDEA nor SC specifies timeframe or form …to specify either would effectively counter the intent of providing additional flexibility to parents in scheduling IEP meetings. Excusal of IEP Team Members - Assurances • District may not unilaterally or routinely excuse IEP Team members – consent required for each excusal. • District defines who has authority to excuse members: LEA Representative (in consultation with the case manager) • Last minute excusals, parent always has right not to agree or consent to excusal. • - Information from meeting must be shared with excused member(s).   12. Excusal of IEP Team Members • If parent does not attend and does not respond, then no agreement – Reschedule • If member is excused and excusal inhibits development of IEP – Reconvene with member or with written input

Modifying the IEP w/o a Meeting • IDEA 04 allows for modifications to the IEP without an IEP meeting if certain conditions are met… • Parent and District mustagree to this approach • Changes must be in writing. • All team members must be informed of the changes. • Cannot be used for an Annual Review. • Applies only to clerical errors. District defines who has authority to modify the IEP: LEA Representative/case manager special educator

  15. Modifying the IEP w/o a Meeting After initial IEP development or Annual Review Written amendment/modification Agreement with the amendment/modification Incorporate into the IEP

  16. Modifying an IEP without a Meeting Case Manager/Special Educator: 1. contacts the parent; 2. makes changes in EXCENT; 3. completes IEP-A; 4. sends letter & changed pages to parent; 5. informs via copies to all team members.

  17. Records • More comprehensive procedures governing the collection, maintenance, disclosure and destruction of special education records. • Developed over last year – work group • Records Room should be • considered the Fort Knox • of our special ed records!

Records – Key Points for School Personnel- Collection • All originals will be stored in the Records Room. • If it’s stored in EXCENT, then don’t send it to the Records Room. • Confidential envelopes must be used from school to school/RR. • Within 5 school days after staffing, school psych/SLP submits: • - P-1 - Parcon-1 • Parcon-14 - other • Within 5 school days after staffing, special educator submits: • Signature page of IEP, ESY, BIP, etc. • - IEP-10 - other

Records – Key Points for School Personnel Disclosure • Access, release, transfer or other communication regarding “the education records of a student or of personally identifiable information contained therein, orally or in writing, or by electronic means, or by an other means to any party.” • Written parental consent must be obtained prior to disclosure…. except….pg. 4 • Record (ACC-1) of access to student records. Use it! • Maintaining databases of records released • Record transfer of folders in Access Log in EXCENT. • Channel all requests to inspect/review • records to Records Room.

Records – Key Points for School Personnel Amendment • Parent may request the record be amended if he/she believes the information is inaccurate, misleading or violates the privacy rights of the student. • All requests for amending the record must be in writing and will be directed to the Director of Special Education. • If YOU find a record is inaccurate, contact Dr. Pat • in the Records Room.

  21. Records –Key Points for School Personnel Destruction HCS may destroy records when “no longer needed” Destruction of records is handled through Director of Special Education.

Reminders – 07-08 processes/procedures: • Reevaluation – Transfer info • 10 school day meeting & IEP • Eligibility – Parcon-E to P-1 =60 day timeline • Imperative – Inform all staff that Consent to Evaluate goes to school psych/speech clinician immediately • IEP/Staffing Meeting Summary: PWN • 4 questions must ALWAYS be answered • Section D: When in doubt, fill it out!
