  5. COURT DECREE C. Terms 1. Decree apply to all correctional facilities operated by the Division of Correction of the Maryland Department of Public Safety & Correctional Services.

  6. COURT DECREE D. Background • The Decree, & its provisions, was written in response to two law suits filed separately by a group of inmates & female employees of the Department of Correction

  7. COURT DECREE 2. The court consolidated the suits & required all parties to meet and develop and acceptable solution to the problem(s)

  8. COURT DECREE 3. At the time DOC policy restricted female employees from supervising male inmates in housing units because of the possibility of females seeing an inmate in a state of undress.

  9. COURT DECREE 4. To be promoted, a correctional officer must have supervised all aspects of inmate life. As long as this conflict existed, female officers could not advance in grade or responsibility.

  10. COURT DECREE 5. The inmate suit was aimed at increasing the level of privacy available at the various institutions.

  11. COURT DECREE E. Provisions of the Court Decree 1. The state shall hire, assign & promote female correctional officers in the same manner as a male officer.

  12. COURT DECREE 2. The state shall distribute to all staff and inmates DOC Regulation 210-3 requiring inmates to be suitably clothed at all times within the institution.

  13. COURT DECREE 3. During mass showering, the facility will provide shower curtains to shield the mid torso on the inmates from view of female officers.

  14. COURT DECREE 4. Dormitory style housing: To grant a level of privacy to male inmates a fifteen minute period of time will be set aside during which female officers will be relieved by male officers to permit inmates to perform activities involving changing clothes.

  15. COURT DECREE 5. In order to accommodate the inmate’s privacy the following areas will adhere to this court decree: a. Shower Area b. Inmate Cells Area

  16. COURT DECREE 6. With the approval of the managing officer inmates will be allowed to rearrange the interior of their cell as to screen the lower portion of the body while using the toilet.

  17. COURT DECREE 7. Inmates are required to be clothed in a manner that covers the mid- torso area including the genital & anal area while sleeping.

  18. COURT DECREE 8. Female officers will perform late night cell check that involve the use of flashlights to take the count & ensure that inmates are properly in their cells.

  19. COURT DECREE 9. Female officers may frisk search male inmates. 10. Female Officer may not touch the genital or anal area of a male inmate.

  20. COURT DECREE 11. While a female officer is conducting a frisk search of a male inmate, she suspects the concealment of contraband in the genital area.

  21. COURT DECREE 12. It is permissible for the female to ask a male officer to search the genital area.

  22. COURT DECREE 13. Strip Searches a. Must be same sex officer b. A female correctional officer may use her own judgment regarding the performance of a strip search in an emergency situation.

  23. COURT DECREE 14. Male correctional officers may not frisk search female inmates. 15. Female correctional officers may enter the toilet & shower facilities in an event of an emergency .

  24. COURT DECREE 16. All newly hired individuals shall be given specialized training of this Decree.

  25. COURT DECREE 17. The Court Decree mandates equal treatment of both male & female correctional officers in determining post.
