8. VCX-Series System by XDM Machine Warranty Terms: The Machine will have a 12 Months of Warranty. During this period, if any defect is noticed, the same should be brought to our notice immediately. We will investigate such complaints and either repair or replace the component found defective if the defect is found to be a manufacturing defect. Our decision in this regard will be final and binding. This guarantee will, however, not cover damage during transit, damage due to bad storage, damage due to misuse and/or mishandling of the equipment and normal wear and tear. Electrical components warranty will be subject to Electrical Equipment manufacturers. Statutory Variations: If the delay in Supply / Erection and Commissioning is due to reasons beyond the purview of the supplier, the Statutory variations in government taxes shall be payable by the purchaser. We shall provide documentary justification for reasons beyond our purview. Erection, Construction & Commissioning Services: XDM is not considering Unloading, Erection, Piping, Cabling and/or any Civil Construction for the Equipment’s. XDM’s Scope of Work is restricted only up to supply of equipment’s and supervision of erection and commissioning on per man day basis thereafter. Pump Warranty Terms: The Vacuum pumps will be guaranteed for a period of 12 months from the date of commissioning or 4000 running hrs or 18 months from the date of invoicing/Bill of lading, whichever ends earlier, against any manufacturing defects such as bad/poor quality of raw materials used, and/or bad workmanship. Consequential damages: "Atlas Copco” will not be responsible nor will it be held liable for any loss or damages arising to the buyer, as a result of delay, if any, in delivery / commissioning of the machine/s and /or the products of the Company due to the non-availability of site or reasons beyond the control of AC or for any product deficiency arising by reason of improper or wrongful use by the buyers of the machinery and/ or the products of the AC. AC will also not be liable for any consequential damages to the buyer or any other person either by way of loss of profits or otherwise, in connection with the use and performance of the machinery and/or the products of AC or for any reason whatsoever.”
