Constructive eviction

As a tenant in New York City, you have the right to live in a safe and habitable apartment. When your landlord fails to maintain those basic conditions, and the situation becomes so intolerable that you are effectively forced to move out, you may be experiencing what is known as constructive eviction. Constructive eviction occurs when a landlord, either through action or inaction, makes the living conditions so unbearable that a reasonable tenant has no choice but to vacate the property.
