ConventiononInternationalTrade • inEndangeredSpeciesofWildFaunaandFlora • SignedatWashington,D.C.,on3March1973 AmendedatBonn,on22June1979AmendedatGaborone,on30April1983 • The ContractingStates, • Recognizingthatwildfaunaandfloraintheirmanybeautifulandvariedformsarean irreplaceablepartofthenaturalsystemsoftheearthwhichmustbeprotectedforthisandthe generationsto come; • Consciousoftheever-growingvalueofwildfaunaandflorafromaesthetic,scientific,cultural, recreationalandeconomicpointsof view; • RecognizingthatpeoplesandStatesareandshouldbethebestprotectorsoftheirownwild faunaandflora; • Recognizing,inaddition,thatinternationalco-operationisessentialfortheprotectionofcertain speciesof wildfauna and floraagainstover-exploitationthroughinternationaltrade; • Convincedofthe urgencyoftaking appropriatemeasures tothisend; • Haveagreedasfollows: • Article IDefinitions • ForthepurposeofthepresentConvention,unlessthecontextotherwiserequires: • “Species”meansanyspecies,subspecies, orgeographicallyseparatepopulationthereof; • “Specimen”means: • anyanimalor plant,whetheraliveordead; • inthecaseofananimal:forspeciesincludedinAppendicesIandII,anyreadily recognizablepartorderivativethereof;andforspeciesincludedinAppendixIII,any readily recognizablepart orderivativethereofspecified inAppendix III inrelationtothe species;and • in thecaseofaplant:forspeciesincludedinAppendixI,anyreadilyrecognizablepartor derivativethereof;andforspeciesincludedinAppendicesIIandIII,anyreadilyrecognizable partor derivative thereof specified inAppendices IIandIIIin relationtothespecies; • “Trade” meansexport,re-export, importand introduction fromthe sea; • “Re-export”meansexportofanyspecimenthathas previouslybeenimported; • “Introductionfromthesea”meanstransportation intoaStateofspecimens ofanyspecies which weretakeninthemarineenvironmentnotunderthejurisdictionofanyState; • “ScientificAuthority”meansanationalscientificauthoritydesignatedinaccordancewith ArticleIX; • “Management Authority”means a nationalmanagementauthoritydesignatedin accordancewith ArticleIX; • “Party”meansa State forwhichthepresentConventionhasenteredintoforce. Textof theConvention –1

Article II Fundamentalprinciples • AppendixIshallincludeallspeciesthreatenedwithextinctionwhichareormaybeaffectedby trade.Tradeinspecimensofthesespeciesmustbesubjecttoparticularlystrictregulationin ordernottoendangerfurthertheirsurvivalandmustonlybeauthorizedinexceptional circumstances. • AppendixIIshallinclude: • allspecieswhichalthoughnot necessarilynowthreatenedwithextinctionmaybecomeso unlesstradeinspecimensofsuchspeciesissubjecttostrictregulationinordertoavoid utilizationincompatiblewiththeirsurvival;and • otherspecieswhichmustbesubjecttoregulationinorderthattradeinspecimensofcertain speciesreferredtoinsub-paragraph(a)ofthisparagraphmaybebroughtundereffective control. • AppendixIIIshallincludeallspecieswhichanyPartyidentifiesasbeingsubjecttoregulation withinits jurisdiction forthepurposeofpreventing or restricting exploitation,and asneedingthe co-operationofotherParties inthecontroloftrade. • ThePartiesshallnotallowtradeinspecimensofspeciesincludedinAppendicesI,IIandIII except in accordancewiththe provisionsofthe presentConvention. Article III Regulationof trade in specimens of species included inAppendix I • AlltradeinspecimensofspeciesincludedinAppendixIshallbeinaccordancewiththe provisions ofthisArticle. • Theexportofanyspecimen ofa species included inAppendixIshallrequirethepriorgrantand presentationofanexportpermit.Anexportpermitshallonlybegrantedwhenthefollowing conditionshavebeenmet: • aScientificAuthorityoftheStateofexporthasadvisedthatsuchexportwillnotbe detrimentaltothesurvivalofthatspecies; • aManagementAuthorityoftheStateofexportissatisfiedthatthespecimenwasnot obtainedincontraventionofthelawsofthatState fortheprotectionoffaunaandflora; • aManagementAuthorityofthe Stateofexportissatisfiedthatanylivingspecimenwillbe so preparedandshippedastominimizetheriskofinjury, damagetohealthorcruel treatment; and • aManagementAuthorityoftheStateofexportissatisfiedthatanimportpermithasbeen grantedforthespecimen. • TheimportofanyspecimenofaspeciesincludedinAppendixIshallrequirethepriorgrantand presentationofanimportpermitandeitheranexportpermitora re-export certificate. An import permitshallonlybegrantedwhenthefollowingconditionshavebeenmet: • aScientific Authority oftheStateofimporthas advisedthat theimportwillbe for purposes whicharenotdetrimentaltothesurvivalofthespeciesinvolved; • a ScientificAuthority of theStateofimportissatisfiedthattheproposed recipient ofa living specimenissuitablyequippedtohouseandcareforit;and • aManagementAuthorityoftheStateofimportissatisfiedthatthespecimenisnottobe usedfor primarilycommercialpurposes. The re-exportofanyspecimenofaspeciesincludedinAppendixIshallrequirethepriorgrant andpresentationofare-export certificate.Are-export certificate shallonlybegrantedwhenthe followingconditions havebeen met: • aManagementAuthorityofthe Stateofre-exportissatisfiedthatthespecimenwasimported intothatState inaccordancewiththeprovisionsofthepresentConvention; • a ManagementAuthority oftheStateofre-exportissatisfiedthatanyliving specimenwill be sopreparedandshippedastominimizetheriskofinjury,damagetohealthorcruel treatment;and • a ManagementAuthorityoftheStateof re-export issatisfiedthatan import permithasbeen granted foranyliving specimen. • Theintroductionfrom thesea ofany specimenof aspeciesincluded inAppendixI shallrequire thepriorgrantofacertificatefromaManagementAuthorityoftheStateofintroduction.A certificateshallonlybe grantedwhenthe followingconditionshavebeenmet: • aScientificAuthorityoftheStateofintroductionadvisesthattheintroductionwillnotbe detrimentaltothe survivalofthe species involved; • a ManagementAuthority oftheStateofintroductionissatisfied thattheproposed recipientof alivingspecimenissuitablyequippedtohouseandcareforit; and • aManagementAuthorityoftheStateofintroductionissatisfiedthatthespecimenisnotto be usedfor primarilycommercialpurposes. Article IV Regulationof trade in specimens of species included inAppendix II • AlltradeinspecimensofspeciesincludedinAppendixIIshallbeinaccordancewiththe provisions ofthisArticle. • TheexportofanyspecimenofaspeciesincludedinAppendixIIshallrequirethepriorgrantand presentationofanexportpermit.Anexportpermitshallonlybegrantedwhenthefollowing conditionshavebeenmet: • aScientificAuthorityoftheStateofexporthasadvisedthatsuchexportwillnotbe detrimentaltothesurvivalofthatspecies; • aManagementAuthorityoftheStateofexportissatisfiedthatthespecimenwasnot obtainedincontraventionofthelawsofthatState fortheprotectionoffaunaandflora;and • aManagementAuthority oftheState ofexportissatisfied thatanyliving specimenwillbeso preparedandshippedastominimize theriskofinjury,damagetohealthorcrueltreatment. • AScientificAuthorityineachPartyshallmonitorboththeexportpermitsgrantedbythatStateforspecimensofspeciesincludedinAppendixIIandtheactualexportsofsuchspecimens.WheneveraScientificAuthoritydeterminesthattheexportofspecimensofanysuchspeciesshouldbelimitedinordertomaintainthatspeciesthroughoutitsrangeatalevelconsistentwithitsroleintheecosystemsinwhichitoccursandwellabovethelevelatwhichthatspeciesmightbecomeeligibleforinclusioninAppendixI,theScientificAuthorityshalladvisetheappropriateManagementAuthorityofsuitablemeasurestobetakentolimitthegrantofexportpermitsforspecimensofthatspecies. • TheimportofanyspecimenofaspeciesincludedinAppendixIIshallrequiretheprior presentationofeitheranexportpermitorare-exportcertificate. There-exportofanyspecimenofaspeciesincludedinAppendixIIshallrequirethepriorgrant andpresentationofare-export certificate.Are-export certificate shallonlybegrantedwhenthe followingconditions havebeen met: • aManagementAuthorityofthe Stateofre-exportissatisfiedthatthespecimenwasimported intothatStateinaccordancewiththeprovisionsofthepresentConvention; and • aManagementAuthorityoftheState ofre-exportissatisfiedthatanylivingspecimen willbe sopreparedandshippedastominimizetheriskofinjury,damagetohealthorcruel treatment. • Theintroduction fromtheseaofany specimenofa species includedinAppendixIIshall require thepriorgrantofacertificatefromaManagementAuthorityoftheStateofintroduction.A certificateshallonlybe grantedwhenthe followingconditionshavebeenmet: • aScientificAuthorityoftheStateofintroductionadvisesthattheintroductionwillnotbe detrimental tothesurvival ofthe species involved;and • aManagement Authorityofthe State of introductionissatisfied thatanyliving specimenwill besohandledastominimizetheriskof injury, damagetohealthorcrueltreatment. • Certificates referredtoinparagraph6ofthisArticle maybegranted onthe advice of aScientific Authority,inconsultationwithothernationalscientificauthoritiesor,whenappropriate, international scientificauthorities,inrespectofperiodsnotexceedingoneyearfortotalnumbers ofspecimenstobeintroducedinsuchperiods. ArticleV Regulationoftrade in specimens of species included inAppendix III • AlltradeinspecimensofspeciesincludedinAppendixIIIshallbeinaccordancewiththe provisions ofthisArticle. • TheexportofanyspecimenofaspeciesincludedinAppendixIIIfromanyStatewhichhas included thatspeciesinAppendixIIIshallrequirethepriorgrantandpresentationofanexport permit.Anexportpermitshallonlybegrantedwhenthefollowingconditionshavebeenmet: • aManagementAuthorityoftheStateofexportissatisfiedthatthespecimenwasnot obtainedincontraventionofthelawsofthatState fortheprotectionoffaunaandflora;and • aManagementAuthorityoftheStateofexportissatisfiedthatanylivingspecimen willbeso preparedandshippedastominimizetheriskofinjury, damagetohealthorcrueltreatment. • TheimportofanyspecimenofaspeciesincludedinAppendixIIIshallrequire,exceptin circumstancestowhichparagraph 4ofthis Articleapplies, thepriorpresentation ofa certificateof originand, where theimport isfromaState whichhasincluded thatspecies in AppendixIII, an exportpermit. • Inthecaseofre-export,acertificategrantedbytheManagementAuthorityoftheStateofre- exportthatthespecimen was processedin that Stateor is being re-exported shall be accepted bytheStateofimportasevidencethattheprovisionsofthepresentConventionhavebeen compliedwithinrespect ofthe specimen concerned. ArticleVI Permitsandcertificates 1. PermitsandcertificatesgrantedundertheprovisionsofArticlesIII,IV,andVshallbein accordancewiththeprovisionsofthisArticle. Textof theConvention –4

  6. AnexportpermitshallcontaintheinformationspecifiedinthemodelsetforthinAppendix IV,and mayonlybeusedforexportwithinaperiodofsixmonthsfromthedateonwhichitwasgranted. EachpermitorcertificateshallcontainthetitleofthepresentConvention,thenameandany identifyingstampoftheManagementAuthoritygrantingitandacontrolnumberassignedbythe Management Authority. Anycopiesofa permitorcertificateissuedbya ManagementAuthorityshallbeclearly marked ascopiesonlyandnosuchcopymaybeusedinplaceoftheoriginal,excepttotheextent endorsedthereon. Aseparatepermitorcertificateshallberequiredforeachconsignmentofspecimens. AManagementAuthorityoftheStateofimportofanyspecimenshall cancelandretainthe exportpermitorre-exportcertificateandanycorrespondingimportpermitpresentedinrespectoftheimportofthatspecimen. Whereappropriate andfeasiblea ManagementAuthoritymayaffixamark uponanyspecimento assistinidentifyingthespecimen. For thesepurposes “mark” meansanyindelible imprint,lead seal orother suitablemeans of identifyingaspecimen,designedinsucha wayastorenderits imitation byunauthorizedpersonsasdifficultaspossible. ArticleVII Exemptionsandotherspecial provisionsrelatingtotrade • Theprovisionsof ArticlesIII,IVandVshallnotapplytothetransitor transhipmentofspecimens throughorintheterritoryofaPartywhilethespecimensremaininCustomscontrol. • WhereaManagementAuthorityoftheStateofexportorre-exportissatisfiedthataspecimen wasacquiredbeforetheprovisionsofthepresentConventionappliedtothatspecimen,the provisionsofArticlesIII,IVandVshallnotapplytothatspecimenwheretheManagement Authorityissuesacertificatetothateffect. • TheprovisionsofArticlesIII,IVandVshallnotapplytospecimensthatarepersonalor household effects.This exemption shallnotapplywhere: • inthecaseofspecimensofaspeciesincludedinAppendixI,theywereacquiredbythe owneroutsidehisStateofusualresidence,andarebeingimportedintothatState;or • inthecaseof specimens of species includedinAppendix II: • theywereacquiredbytheowneroutsidehisStateofusualresidenceandinaState whereremovalfromthewildoccurred; • theyarebeingimportedintotheowner'sState ofusualresidence;and • theStatewhereremovalfromthewildoccurredrequiresthepriorgrantofexport permitsbeforeanyexportofsuchspecimens; • unlessaManagementAuthorityissatisfiedthatthespecimenswereacquiredbeforethe provisionsofthepresentConventionappliedtosuchspecimens. • SpecimensofananimalspeciesincludedinAppendixIbredincaptivityforcommercial purposes,orofaplantspeciesincludedinAppendixIartificiallypropagatedforcommercial purposes, shallbedeemedtobespecimensofspeciesincludedinAppendix II. • WhereaManagementAuthorityofthe State ofexportissatisfiedthatanyspecimenofananimal specieswasbredincaptivityoranyspecimenofaplantspecieswasartificially propagated,oris apartofsuchananimalorplantorwasderivedtherefrom,acertificatebythatManagement Authoritytothateffectshallbeacceptedinlieuofanyofthe permitsor certificatesrequiredunder theprovisionsofArticleIII,IVorV. • Textof theConvention –5

TheprovisionsofArticlesIII,IVandVshallnotapplytothenon-commercialloan,donationor exchange between scientistsor scientificinstitutions registered bya ManagementAuthorityof theirState,ofherbariumspecimens, otherpreserved, dried orembedded museum specimens, andliveplantmaterialwhichcarryalabelissuedor approvedbya ManagementAuthority. • AManagementAuthorityofanyStatemaywaivetherequirementsofArticlesIII,IVandVand allowthemovementwithoutpermitsorcertificatesofspecimenswhichformpartofatravelling zoo,circus,menagerie, plantexhibition orother travellingexhibition providedthat: • theexporterorimporterregistersfulldetailsofsuchspecimenswiththatManagement Authority; • thespecimensareineitherofthecategoriesspecifiedinparagraph2or5ofthisArticle;and • theManagementAuthorityissatisfiedthatanylivingspecimenwillbesotransportedand caredforastominimizetheriskofinjury,damagetohealthorcrueltreatment. ArticleVIII Measurestobetakenbythe Parties • ThePartiesshalltakeappropriatemeasurestoenforcetheprovisionsofthepresentConvention andtoprohibittradeinspecimens in violationthereof.Theseshallincludemeasures: • topenalizetradein,orpossessionof,suchspecimens,orboth;and • toprovidefortheconfiscationorreturntotheStateofexportofsuchspecimens. • Inadditiontothemeasurestakenunderparagraph1ofthis Article,aParty may, whenitdeems it necessary,provideforanymethodofinternalreimbursementforexpensesincurredasaresultof theconfiscationofaspecimentradedinviolationofthemeasurestakenintheapplicationofthe provisionsofthepresentConvention. • Asfaraspossible,thePartiesshallensurethatspecimensshallpassthroughanyformalities requiredfortradewithaminimumofdelay.Tofacilitatesuchpassage,aPartymaydesignate portsofexitandportsofentryatwhichspecimensmustbepresentedforclearance.TheParties shallensurefurther thatalllivingspecimens,duringanyperiodoftransit,holdingor shipment, are properlycaredforsoastominimizetheriskofinjury,damagetohealthorcrueltreatment. • Wherealivingspecimenisconfiscatedasaresultofmeasures referredtoinparagraph1ofthis Article: • thespecimen shallbeentrusted toaManagementAuthority oftheStateofconfiscation; • theManagementAuthorityshall,afterconsultationwiththeStateofexport,returnthe specimentothatStateattheexpenseofthat State,ortoarescuecentreorsuchotherplace astheManagementAuthoritydeemsappropriateandconsistentwiththepurposesofthe presentConvention; and • theManagementAuthoritymayobtaintheadviceofaScientific Authority,ormay, whenever it considers it desirable, consulttheSecretariat inordertofacilitatethe decisionundersub- paragraph(b)ofthisparagraph,includingthechoiceofarescuecentreorotherplace. • Arescuecentreasreferredtoinparagraph4ofthis Articlemeansaninstitutiondesignatedbya Management Authoritytolookafterthewelfareoflivingspecimens, particularlythosethathave beenconfiscated. • EachPartyshallmaintainrecordsoftradeinspecimensofspeciesincludedinAppendicesI,II andIIIwhichshallcover: • thenamesand addresses of exportersand importers; and • thenumberandtypeofpermitsandcertificatesgranted;theStateswithwhichsuchtrade occurred;thenumbersorquantitiesandtypesofspecimens,namesofspeciesas included • Textof theConvention –6

  8. inAppendicesI,IIandIIIand,whereapplicable,thesizeandsexofthespecimensin question. • EachPartyshallprepareperiodicreportsonitsimplementationofthepresentConventionand shalltransmittotheSecretariat: • anannualreport containingasummaryof theinformationspecifiedinsub-paragraph(b)of paragraph6ofthisArticle;and • a biennial reportonlegislative,regulatoryandadministrativemeasurestaken to enforcethe provisionsofthepresentConvention. • Theinformationreferredtoinparagraph7ofthisArticleshallbeavailabletothepublicwherethis isnotinconsistentwiththelawofthePartyconcerned. Article IX Management and ScientificAuthorities • EachPartyshalldesignateforthepurposesofthepresentConvention: • oneormoreManagementAuthorities competenttograntpermits orcertificatesonbehalfof thatParty; and • oneormoreScientificAuthorities. • AStatedepositinganinstrumentofratification,acceptance,approvaloraccessionshallatthat timeinformtheDepositary Government ofthename andaddress of the ManagementAuthority authorizedtocommunicatewithotherPartiesandwiththeSecretariat. • AnychangesinthedesignationsorauthorizationsundertheprovisionsofthisArticleshallbe communicatedbythePartyconcernedtotheSecretariatfortransmissiontoallotherParties. • AnyManagement Authority referredto inparagraph2ofthis Articleshall,ifsorequested by the SecretariatortheManagementAuthorityofanotherParty,communicatetoitimpressionof stamps,sealsorotherdevicesusedtoauthenticatepermits orcertificates. Article XTradewithStatesnotpartytotheConvention Whereexportorre-exportisto,orimportisfrom,aStatenotaPartytothepresentConvention, comparabledocumentationissuedbythecompetentauthoritiesinthatStatewhichsubstantially conformswiththerequirementsofthepresentConventionforpermitsandcertificatesmaybe acceptedinlieuthereofbyanyParty. Article XI Conferenceofthe Parties TheSecretariatshallcallameetingoftheConferenceofthePartiesnotlaterthantwoyearsafter theentryintoforceofthepresentConvention. ThereaftertheSecretariatshallconveneregularmeetingsatleastonceeverytwoyears,unless theConferencedecides otherwise,andextraordinarymeetingsatanytimeonthewrittenrequest ofatleastone-thirdoftheParties. Atmeetings, whether regularorextraordinary,thePartiesshall review theimplementationofthe presentConventionandmay: • make such provision as maybenecessary to enabletheSecretariattocarryoutitsduties, andadoptfinancial provisions; • considerandadoptamendments toAppendices IandIIin accordance withArticleXV; • reviewtheprogressmadetowardstherestorationandconservationofthespeciesincluded inAppendicesI,IIandIII; • receiveand consider anyreportspresented bythe SecretariatorbyanyParty; and • whereappropriate,makerecommendationsforimprovingtheeffectivenessofthepresent Convention. • Ateachregularmeeting,thePartiesmaydeterminethetimeandvenueofthenextregular meetingtobeheldinaccordancewiththe provisionsofparagraph2ofthisArticle. • Atanymeeting,thePartiesmaydetermineandadoptrulesofprocedureforthemeeting. • TheUnitedNations, its SpecializedAgenciesand theInternational AtomicEnergy Agency,as well asanyStatenotaPartytothepresentConvention,mayberepresentedatmeetingsofthe Conferencebyobservers,whoshallhavetherighttoparticipatebutnottovote. • Anybodyoragency technically qualifiedin protection,conservationormanagementofwild fauna andflora,inthefollowingcategories,whichhasinformedtheSecretariatofitsdesiretobe representedat meetingsofthe Conference by observers,shallbe admitted unlessatleastone- thirdofthePartiespresentobject: • internationalagenciesorbodies,eithergovernmentalornon-governmental,andnational governmentalagenciesandbodies;and • nationalnon-governmentalagenciesorbodieswhichhavebeenapprovedforthispurpose bytheStateinwhichtheyarelocated. • Onceadmitted,theseobserversshallhavetherighttoparticipatebutnottovote. Article XII The Secretariat • Uponentryintoforceofthepresent Convention,a SecretariatshallbeprovidedbytheExecutive DirectoroftheUnitedNationsEnvironmentProgramme.Totheextentandinthemannerhe considersappropriate,hemaybeassistedbysuitableinter-governmentalornon-governmental internationalornationalagenciesandbodiestechnicallyqualifiedinprotection,conservationand managementofwildfaunaandflora. • ThefunctionsoftheSecretariatshallbe: • toarrangeforandservicemeetingsoftheParties; • toperformthefunctionsentrustedtoitundertheprovisionsofArticlesXVandXVIofthe presentConvention; • to undertakescientificandtechnicalstudiesinaccordancewithprogrammesauthorizedby theConferenceofthePartiesaswillcontributetotheimplementationofthepresent Convention,includingstudiesconcerningstandardsforappropriatepreparationand shipmentoflivingspecimensandthemeansofidentifyingspecimens; • tostudythereportsofPartiesandtorequestfromPartiessuchfurtherinformationwith respecttheretoasitdeemsnecessarytoensure implementationofthepresentConvention; Textof theConvention –8

  10. toinvitetheattentionofthePartiestoanymatterpertainingtotheaimsofthepresent Convention; topublishperiodicallyanddistributetothePartiescurrent editions ofAppendicesI,IIandIII togetherwithanyinformationwhichwillfacilitateidentificationofspecimensofspecies includedinthoseAppendices; toprepareannualreportstothePartiesonitsworkandontheimplementationofthepresent ConventionandsuchotherreportsasmeetingsofthePartiesmayrequest; tomakerecommendations fortheimplementationoftheaims and provisionsofthe present Convention,including the exchangeofinformationofascientificortechnical nature; toperformanyotherfunctionasmaybeentrustedtoitbytheParties. Article XIII International measures WhentheSecretariatinthelightofinformationreceivedis satisfiedthatanyspeciesincludedin AppendixIorIIisbeingaffectedadverselybytradeinspecimensofthatspeciesorthatthe provisionsofthepresent Conventionarenotbeingeffectivelyimplemented,itshall communicate suchinformation totheauthorized ManagementAuthority ofthePartyorPartiesconcerned. WhenanyPartyreceives acommunicationas indicatedinparagraph1ofthisArticle,itshall,as soonaspossible,informtheSecretariatofanyrelevantfactsinsofarasitslawspermitand, whereappropriate,proposeremedialaction.WherethePartyconsidersthataninquiryis desirable, such inquirymaybe carriedoutbyone or more personsexpresslyauthorized by the Party. TheinformationprovidedbythePartyorresultingfromanyinquiryasspecifiedin paragraph2of thisArticleshallbereviewedbythenextConferenceofthePartieswhichmay makewhatever recommendationsitdeemsappropriate. Article XIV Effecton domesticlegislation andinternational conventions • TheprovisionsofthepresentConventionshallinnowayaffecttherightofPartiestoadopt: • stricterdomesticmeasuresregardingtheconditionsfortrade,taking,possessionor transportofspecimensofspeciesincludedinAppendicesI,IIandIII,orthecomplete prohibitionthereof;or • domesticmeasuresrestrictingorprohibitingtrade, taking,possessionortransportof species notincludedinAppendixI,IIorIII. • TheprovisionsofthepresentConventionshallinnowayaffecttheprovisionsofanydomestic measuresortheobligationsofPartiesderivingfromanytreaty,convention,orinternational agreementrelatingtootheraspectsoftrade,taking,possessionortransportofspecimenswhich isinforceorsubsequentlymayenterintoforceforanyPartyincludinganymeasurepertaining to theCustoms,publichealth, veterinaryorplant quarantinefields. • TheprovisionsofthepresentConventionshallinnowayaffecttheprovisionsof,orthe obligationsderiving from,any treaty,convention orinternationalagreementconcludedorwhich maybeconcludedbetweenStatescreating aunionorregionaltradeagreementestablishingor maintainingacommonexternalCustomscontrolandremovingCustomscontrolbetweenthe Textof theConvention –9

  11. partiestheretoinsofarastheyrelatetotradeamongtheStatesmembersofthatunionor agreement. AStatepartytothepresent Convention, whichis alsoapartytoanyothertreaty,conventionor internationalagreementwhichisinforceatthetimeofthecomingintoforceofthepresent Conventionandundertheprovisionsofwhichprotectionis affordedtomarinespecies included in AppendixII,shallberelievedoftheobligationsimposedonitundertheprovisionsofthepresent Conventionwithrespectto tradeinspecimensof speciesincludedin AppendixII that are taken byshipsregisteredinthatStateandinaccordancewiththeprovisionsofsuchothertreaty, conventionor internationalagreement. NotwithstandingtheprovisionsofArticlesIII,IVandV,anyexportofaspecimentakenin accordancewithparagraph4ofthisArticleshallonlyrequireacertificatefromaManagement AuthorityoftheState ofintroduction tothe effectthatthespecimenwastakenin accordancewith the provisionsoftheothertreaty, convention orinternationalagreement inquestion. NothinginthepresentConventionshallprejudicethecodification anddevelopmentofthelawof theseabytheUnitedNationsConferenceontheLawoftheSeaconvenedpursuantto Resolution2750C(XXV)oftheGeneralAssemblyoftheUnitedNations northepresentorfuture claimsandlegalviewsofany Stateconcerning thelawofthe seaand thenatureandextentof coastalandflagState jurisdiction. Article XV AmendmentstoAppendices I andII • Thefollowingprovisionsshallapplyinrelationtoamendmentsto AppendicesIandIIatmeetings oftheConferenceoftheParties: • AnyPartymayproposeanamendmenttoAppendixIorIIforconsiderationatthenext meeting.Thetextofthe proposed amendment shallbecommunicatedtotheSecretariatat least150daysbeforethemeeting.TheSecretariatshallconsulttheotherPartiesand interestedbodiesontheamendmentinaccordancewiththeprovisionsofsub- paragraphs(b)and(c)of paragraph2ofthis Article andshallcommunicate theresponseto allPartiesnotlaterthan30daysbeforethemeeting. • Amendmentsshallbeadoptedbyatwo-thirdsmajorityofPartiespresentandvoting.For thesepurposes“Partiespresentandvoting”meansPartiespresentandcastingan affirmativeornegativevote.Partiesabstainingfromvotingshallnotbecountedamongthe two-thirdsrequired for adopting anamendment. • Amendments adopted ata meetingshallenterintoforce90daysafterthatmeetingforall Partiesexceptthosewhichmakeareservationinaccordancewithparagraph3ofthis Article. • ThefollowingprovisionsshallapplyinrelationtoamendmentstoAppendicesIandIIbetween meetingsoftheConferenceoftheParties: • AnyPartymayproposeanamendmenttoAppendixIorIIforconsiderationbetween meetingsbythepostalproceduressetforthinthisparagraph. • Formarinespecies,theSecretariatshall,uponreceivingthetextoftheproposed amendment,immediatelycommunicateittotheParties.Itshallalsoconsultinter- governmentalbodies havingafunctioninrelationtothosespeciesespecially withaviewto obtainingscientific datathesebodiesmaybeabletoprovideandtoensuring co-ordination withanyconservationmeasuresenforcedbysuchbodies.TheSecretariatshall communicatetheviews expressed anddataprovidedbythesebodiesanditsown findings andrecommendationstothePartiesassoonaspossible. • Forspecies otherthanmarinespecies,theSecretariatshall,uponreceiving thetext ofthe proposedamendment,immediatelycommunicateittotheParties,and,assoonaspossible thereafter, itsownrecommendations. • Textof theConvention –10

AnyPartymay,within60daysofthedateonwhichtheSecretariatcommunicatedits recommendationstothePartiesundersub-paragraph(b)or(c)ofthis paragraph,transmitto theSecretariatanycommentsontheproposedamendmenttogetherwithanyrelevant scientificdata andinformation. TheSecretariatshallcommunicatetherepliesreceivedtogetherwithitsown recommendationstothePartiesassoonaspossible. Ifnoobjectiontothe proposedamendmentis receivedbytheSecretariat within 30daysof thedatetherepliesandrecommendations were communicated undertheprovisionsofsub- paragraph(e)ofthisparagraph,theamendmentshallenterintoforce90dayslaterforall Partiesexceptthosewhichmakeareservationinaccordancewithparagraph3ofthis Article. IfanobjectionbyanyPartyis receivedbytheSecretariat,theproposed amendmentshallbe submittedtoa postal voteinaccordancewiththeprovisionsof sub-paragraphs(h),(i)and(j) ofthisparagraph. TheSecretariat shallnotify the Parties thatnotification of objection hasbeenreceived. UnlesstheSecretariatreceivesthevotes for, againstorinabstentionfromatleastone-half ofthePartieswithin60daysofthedateofnotificationundersub-paragraph(h)ofthis paragraph,theproposedamendmentshallbereferredtothenextmeetingofthe Conferenceforfurther consideration. Providedthatvotesarereceivedfromone-halfoftheParties,theamendmentshallbe adopted byatwo-thirds majority of Partiescasting anaffirmative ornegative vote. The Secretariat shallnotifyallPartiesoftheresultofthevote. Iftheproposedamendmentis adopted itshallenterintoforce90daysafterthedateofthe notificationbytheSecretariatofitsacceptanceforallPartiesexceptthosewhichmakea reservation inaccordance withparagraph 3ofthisArticle. 3.Duringtheperiodof90daysprovidedforbysub-paragraph(c)ofparagraph1orsub- paragraph(l)ofparagraph2ofthisArticleanyPartymaybynotificationinwritingtothe DepositaryGovernmentmakeareservationwithrespecttotheamendment. UntilsuchreservationiswithdrawnthePartyshallbetreatedasaState notaPartytothepresent Conventionwithrespecttotradeinthespeciesconcerned. Article XVI Appendix IIIandamendmentsthereto AnyPartymayatanytimesubmittothe Secretariatalistofspecieswhichit identifies as being subjecttoregulationwithinitsjurisdictionforthepurposementionedinparagraph3ofArticleII. AppendixIIIshallincludethenamesofthePartiessubmittingthespeciesforinclusiontherein, thescientificnames of the species so submitted, and any parts orderivativesofthe animalsor plantsconcernedthatarespecifiedinrelationtothespeciesforthepurposesofsub- paragraph(b)ofArticleI. Eachlist submitted underthe provisionsofparagraph1ofthis Articleshall becommunicated to thePartiesbythe Secretariatassoonaspossible after receiving it.The listshalltakeeffectas partofAppendixIII90daysafterthedateofsuchcommunication.Atanytimeafterthe communicationofsuchlist,anyPartymaybynotificationinwriting tothe DepositaryGovernment enterareservationwithrespecttoanyspeciesoranypartsorderivatives,anduntilsuch reservationiswithdrawn,theStateshallbetreatedasaStatenotaPartytothepresent Conventionwithrespecttotradeinthespeciesorpartorderivativeconcerned. APartywhichhassubmittedaspeciesforinclusioninAppendixIIImaywithdrawitatany time by notificationtotheSecretariatwhichshallcommunicatethewithdrawaltoallParties.Thewithdrawalshalltakeeffect30daysafterthedateofsuchcommunication. AnyPartysubmittingalistunder theprovisionsofparagraph1of this Article shallsubmit tothe Secretariatacopyofalldomesticlawsandregulationsapplicabletotheprotectionofsuch species,togetherwithanyinterpretationswhichthePartymaydeemappropriateorthe Secretariatmayrequest.ThePartyshall,foraslongasthespeciesinquestionisincludedin AppendixIII,submitanyamendmentsofsuchlawsandregulationsoranyinterpretationsas they areadopted. Article XVII Amendment of the Convention Anextraordinarymeeting oftheConference oftheParties shallbe convened bythe Secretariat onthe writtenrequestofatleastone-third oftheParties toconsiderand adoptamendmentsto thepresent Convention.Such amendments shallbe adoptedby atwo-thirds majorityof Parties presentandvoting.Forthesepurposes“Partiespresentandvoting”meansPartiespresentand castinganaffirmativeornegativevote.Partiesabstainingfromvotingshallnotbecounted amongthe two-thirdsrequiredfor adopting anamendment. Thetextofanyproposed amendmentshallbecommunicatedbytheSecretariattoall Parties at least90daysbeforethemeeting. AnamendmentshallenterintoforceforthePartieswhichhaveacceptedit60daysaftertwo- thirdsofthePartieshavedepositedaninstrumentofacceptanceoftheamendmentwiththe DepositaryGovernment.Thereafter,theamendmentshallenterintoforceforanyotherParty60 daysafterthatPartydepositsitsinstrumentofacceptanceoftheamendment. Article XVIII Resolution of disputes Any disputewhichmay arisebetweentwoormorePartieswithrespecttotheinterpretationor applicationoftheprovisionsofthepresentConventionshallbesubjecttonegotiationbetween theParties involvedinthedispute. Ifthedisputecannotberesolvedinaccordancewithparagraph1ofthisArticle,thePartiesmay, bymutual consent,submitthedisputetoarbitration,inparticularthatofthe Permanent Courtof ArbitrationatTheHague,andthePartiessubmittingthedisputeshallbeboundbythearbitral decision. Article XIXSignature ThepresentConventionshallbeopenfor signatureatWashingtonuntil30thApril1973andthereafter atBerneuntil31stDecember1974. Textof theConvention –12

Article XX Ratification, acceptance, approval ThepresentConventionshallbesubjecttoratification,acceptanceorapproval.Instrumentsof ratification,acceptanceorapprovalshallbedepositedwiththeGovernmentoftheSwiss ConfederationwhichshallbetheDepositaryGovernment. Article XXIAccession ThepresentConvention shallbeopen indefinitelyforaccession.Instrumentsofaccessionshall bedepositedwiththeDepositaryGovernment. ThisConventionshallbeopenforaccessionbyregionaleconomicintegrationorganizations constitutedbysovereignStateswhichhavecompetenceinrespectofthenegotiation, conclusionandimplementationofinternationalagreementsinmatterstransferredtothemby theirMemberStatesandcoveredbythisConvention. Intheirinstrumentsofaccession,suchorganizationsshalldeclaretheextentoftheir competencewithrespecttothemattersgovernedbytheConvention.Theseorganizations shallalsoinformtheDepositaryGovernmentofanysubstantialmodificationintheextentof theircompetence.Notificationsbyregionaleconomicintegrationorganizationsconcerning theircompetencewithrespecttomattersgovernedbythisConventionandmodifications theretoshallbedistributedtothePartiesbytheDepositaryGovernment. Inmatterswithintheircompetence,suchregionaleconomicintegrationorganizationsshall exercisetherightsandfulfiltheobligationswhichthisConventionattributestotheirMember States,whicharePartiestotheConvention.InsuchcasestheMemberStatesofthe organizationsshallnotbeentitledtoexercisesuchrightsindividually. Inthefieldsoftheircompetence,regionaleconomicintegrationorganizationsshallexercise theirrighttovotewithanumberofvotesequaltothenumberoftheirMemberStateswhich arePartiestotheConvention.Suchorganizationsshallnotexercisetheirrighttovoteiftheir MemberStatesexercisetheirs,andviceversa. Any referenceto “Party”inthe senseusedinArticleI(h)ofthisConventionto“State”/”States” orto“StateParty”/”StateParties”totheConventionshallbeconstruedasincludinga referencetoanyregionaleconomicintegrationorganizationhavingcompetenceinrespectof thenegotiation,conclusionandapplicationofinternationalagreementsinmatterscoveredby thisConvention. Article XXII Entry into force ThepresentConventionshallenterintoforce90daysafterthedateofdepositofthetenth instrumentofratification,acceptance,approvalor accession,withtheDepositaryGovernment. ForeachStatewhichratifies,acceptsorapprovesthepresentConventionoraccedesthereto afterthedepositofthetenthinstrumentofratification,acceptance,approvaloraccession,the presentConventionshallenterintoforce90daysafterthedepositbysuchStateofitsinstrument ofratification,acceptance,approvalor accession. Article XXIIIReservations • TheprovisionsofthepresentConventionshallnotbesubjecttogeneralreservations.Specific reservationsmaybeenteredinaccordancewiththeprovisionsofthisArticleandArticlesXV andXVI. • AnyStatemay,ondepositingitsinstrumentofratification,acceptance,approvaloraccession, enter a specific reservation withregardto: • anyspeciesincludedinAppendixI,IIorIII; or • anypartsorderivatives specified inrelation toaspeciesincludedinAppendixIII. • UntilaPartywithdrawsitsreservationenteredundertheprovisionsofthisArticle,itshallbe treatedasaStatenotaPartytothepresentConventionwithrespecttotradeintheparticular species or parts orderivatives specified insuchreservation. ArticleXXIVDenunciation AnyPartymaydenouncethepresentConvention bywritten notificationtothe DepositaryGovernment atanytime.Thedenunciation shall take effect twelve months after the DepositaryGovernmenthas received thenotification. Article XXVDepositary TheoriginalofthepresentConvention,intheChinese,English,French,RussianandSpanish languages,eachversionbeingequallyauthentic,shallbedepositedwiththeDepositary Government,whichshalltransmitcertifiedcopiesthereoftoallStatesthathavesigneditor depositedinstrumentsofaccessiontoit. The DepositaryGovernmentshallinformallsignatoryandaccedingStatesandtheSecretariatof signatures,depositofinstrumentsofratification,acceptance,approvaloraccession,entryinto forceofthepresentConvention,amendmentsthereto,entryandwithdrawalofreservationsand notifications ofdenunciation. AssoonasthepresentConventionentersintoforce,acertifiedcopythereofshallbetransmitted bytheDepositaryGovernmenttotheSecretariatoftheUnitedNationsforregistrationand publicationin accordancewithArticle102oftheCharter oftheUnited Nations.
