UKM Student Intellectual Property Policy (Supplementary). INTRODUCTION. UKM Intellectual Property Policy and UKM Student’s Intellectual Property Policy (Supplementary) was introduced in the year 2010.

INTRODUCTION • UKM Intellectual Property Policy and UKM Student’s Intellectual Property Policy (Supplementary) was introduced in the year 2010. • It sets forth UKM’s policies in relation to Student’s Intellectual Property Rights (IPR) arising from their participation and contribution to research projects and activities at UKM. • Both Policies together with UKM Associate Intellectual Property Policy, UKM Intellectual Property Commercialisation Policy (Supplementary) and other related policies form part of UKM Intellectual Property Policy framework.
PURPOSE OF POLICY This Policy applies to all Students of UKM. • ‘Student’ means registered student of UKM. • ‘Associate Student’ means non-UKM Student supervised by academic staff of UKM.
SCENARIO • Student as GRA of Research Project • Student Sponsored by External Agency • Self-sponsored Student • Zamalah Scheme Student • Employees of UKM as Student at other Public or Private Institution of Higher Learning • Student does not agree to assign his/her IPR to UKM
SCENARIO 1 – Student as GRA of Research Project • Refer to Clause 4.2 (pg. 83) • the Student(s) is an Employee of UKM; • the Intellectual Property is created, developed or otherwise generated using the facilities, material, funds or other resources owned by UKM; • the Intellectual Property is created with the support and under the supervision of Employess of UKM; • the Intellectual Property Rights (IPR) belongs to a research team whose members are Employees of UKM. • Refer to Clause 4.3 (pg. 83) • are funded by any research grant which UKM has contractual obligations; • revolves around pre-existing Intellectual Property owned or licensed to UKM; or • has Commercialisation Expectation. All Students who participate in any research project or activity in the couse of their study at UKM must sign a Confidentiality Agreement. Refer to Clause 4.2 and 4.3 (pg. 83) – Student(s) to assign in writing, the IPR to UKM, UKM Student (UKM Student Deed of Assignment).
SCENARIO 2 – Student Sponsored by External Agency • Refer to Clause 4.4 (pg. 83) • IPR shall be governed by the terms of the financial assistance agreement. • Ownership of IPR must name all researchers (including Students) involved in the Inventors’ List. • Clause 6 (pg. 84) – all Originators of UKM Intellectual Property, including Students, will receive a share of the income derive from the commercialisation of the Intellectual Property. • Example: • Student sponsored by Nuclear Agency of Malaysia as Master Student at Faculty of Pharmacy, UKM • Jointly Owned Patent Agreement between UKM and Nuclear Agency of Malaysia. • Student as one of the Inventors. All Students who participate in any research project or activity in the couse of their study at UKM must sign a Confidentiality Agreement.
SCENARIO 3 – Self-sponsored Student • Refer to Clause 4.2 (pg. 83) • the Intellectual Property is created, developed or otherwise generated using the facilities, material, funds or other resources owned by UKM; • the Intellectual Property is created with the support and under the supervision of Employees of UKM; • the Intellectual Property Rights (IPR) belongs to a research team whose members are Employees of UKM. • Refer to Clause 4.3 (pg. 83) • revolves around pre-existing Intellectual Property owned or licensed to UKM; or • Has commercialisation potential. All Students who participate in any research project or activity in the couse of their study at UKM must sign a Confidentiality Agreement. Refer to Clause 4.2 and 4.3 (pg. 83) – Student(s) to assign in writing, the IPR to UKM, UKM Student (UKM Student Deed of Assignment).
SCENARIO 4 – Zamalah Scheme Student • Refer to Clause 4.2 (pg. 83) • the Intellectual Property is created, developed or otherwise generated using the facilities, material, funds or other resources owned by UKM; • the Intellectual Property is created with the support and under the supervision of Employees of UKM; • the Intellectual Property Rights (IPR) belongs to a research team whose members are Employees of UKM. • Refer to Clause 4.3 (pg. 83) • are funded by any research grant which UKM has contractual obligations; • revolves around pre-existing Intellectual Property owned or licensed to UKM; or • has Commercialisation Expectation. SCENARIO 5 – Employees of UKM as Student at Other Public or Private Institution of Higher Learning (IHL) • Ownership of the Intellectual Property shall be governed by Intellectual Property Policy of that Public or Private IHL, discussion and agreement. Case 1 • Tutor at Faculty of Enviroment Built and Engineering, UKM. • PhD Research at UiTM. • Jointly Owned Patent Agreement between UKM and UiTM. Case 2 • Tutor at Faculty of Environment Built and Engineering, UKM. • PhD Research at UM. • Patent Agreement owned by UKM; royalty is shared together.
SCENARIO 6 – Student does not agree to assign his/her IPR to UKM Clause 5 (pg. 84) • A Student may choose not to assign his IPR to UKM. • It is the duty of the Student to inform in writing to the supervisor or lead researcher. There after: • the Student, upon consultation with the supervisor or lead researcher, shall develop a different research project which does not come in conflict with Clause 4.2 of this Policy; and • the Student shall not get involved with the research project or activity where UKM has prior contractual obligations with Associate(s), or revolves around pre-existing Intellectual Property owned by UKM or licensed to UKM.
THESIS Clause 4.5 (pg. 83) • Students’ thesis belongs to the Students. • Any assignments of IPR to UKM does not involve Students’ thesis. • UKM has non-exclusive right, royalty-free, and perpetual license to use, reproduce and distribute those works in any manner it deems fit and does not conflict with the moral rights of the authors.
INTELLECTUAL PROPERTY DOCUMENT PLEASE SUBMIT THE RELEVANT DOCUMENTS TO CENTRE OF GRADUATE MANAGEMENT TWO WEEKS (14 DAYS) FROM THE DATE OF REGISTRATION. FAILURE TO DO SO WILL HAVE SOME EFFECT ON YOUR GRADUATION.
