  3. Types of Reevaluation? • There are two types of reevaluations performed by CEO OHP • Medical • Psychological

  4. Medical Reevaluation:What is it? • A Medical Reevaluation is an independent assessment by a County physician to determine whether an employee’s medical condition may pose a direct threat of harm to self or others while performing either essential or non-essential duties • Driving on County time • Operating moving equipment

  5. Common Reasons for Seeking a Medical Reevaluation • Sudden loss of consciousness episode, either on or off duty • Sudden episode of confusion, either on or off duty • Employee had their driver license temporarily suspended due to a medical condition • Employee has poorly controlled sleep apnea as evidenced by sleepiness on the job

Common Reasons for Seeking a Medical Reevaluation • Medical Reevaluations can be requested even if: • Employee has an open WC Claim • However, the medical condition accepted by WC cannot be the same case for medical reevaluation • Medical Reevaluations can be requested despite: • Being returned to full duty by the WC system (so long as the WCAB has no jurisdiction on the claim) • Being returned to full duty by the employee’s personal care provider • Unrestricted licensure by DMV

The Medical ReevaluationRequest Process • When concerns first arise: • Take immediate action • Contact an OHP physician to discuss the case • If OHP determines that a Medical reevaluation is warranted, prepare a written request: • Employee’s information • Full description of concerns • Departmental contact’s information

The Medical ReevaluationRequest Process • Communicate the need for the evaluation to the employee (in writing is advised) • Have employee sign a short consent statement to the reevaluation (attach to written request) • If not possible, document employee’s verbal agreement • If employee refuses, department may seek a formal CEO concurrence to administratively order the employee to undergo reevaluation • Progressive discipline • Departmental responsibility to take administrative action
