  2. Stand des Verfahrens • ECON- Abstimmung: 27. Januar 2014 • Verhandlungen Rat/Europäisches Parlament: bis Ende Februar (voraussichtlich) • Plenarabstimmung: 3. Aprilwoche (voraussichtlich)

  3. Sammelklagen • Empfehlung der Kommission (2013/396/EU): horizontaler und nicht sektorspezifischer Ansatz • Zahlreiche ECON-Änderungsanträge für die Aufnahme von Sammelklagen in die Richtlinie • ECON-Abstimmung: Mehrheit des Ausschusses dagegen

  4. Offenlegung von Beweismitteln • KOM Vorschlag: absoluter Schutz für Kronzeugenunternehmungserklärungen und Vergleichsausführungen vs. EuGH-Rechtssprechung • Ratstext: behält absoluten Schutz bei • ECON-Kompromiss: „In principle“-Schutz • ECON: nur für EU-Fälle, Abschätzung hinsichtlich behördlicher Durchsetzung, Anhörung

  5. Andere Punkte • Gesamtschuldnerische Haftung der Mitglieder des Kartells (Art. 11) • Beweislastumkehr bei Klagen indirekter Abnehmer (Art. 13, 2) • Wirkung einzelstaatlicher Entscheidungen (Art. 9)
