  4. Consumer Price Index CPI • According to the August, 2006 Report: • The New York-Northern New Jersey Area CPI for July, 2006 was 223.1 This represents a 5.0 % increase over the July, 2005 Consumer Price Index

Chapter Financial Status • The DC NYSUT Chapter started February, 2006 with approximately $ 78,000 and we entered September, 2006 with over $ 101,000 • All bills are paid thru August, 2006 • The Spring, 2006 dues increase has positioned the Chapter such that it is no longer operating with a negative deficit budget • Annual Reviews have been completed for 2003-2004, 2004-2005, and 2005-2006 • AFT Reports have been filed and are now up to date • Labor Department and Federal Reports are all up to date • A new computer program consistent with our CPA’s system has been purchased to make future annual reviews more efficient and less costly • Issue of payroll deductions (dues) not being turned over to the Chapter resolved in August

  7. Constitutional Amendments • Amendments to the Dowling College Chapter Constitution are herein presented as seconded motions from the Executive Council of the union. The amendment proposals shall be voted on at the union meeting to be held in October, 2006. • Amendment Proposal # 1 The Dowling College Chapter agrees to recognize the affiliations of NYSUT, AFT, and the AFL-CIO so long as the Dowling College Chapter chooses to remain affiliated with any of the organizations just named. The Dowling College Chapter always reserves its right to disaffiliate with any outside organization that the Chapter’s members deem that it should not be affiliate with. • Amendment Proposal # 2 Elections of the Dowling College Chapter shall, effective November 1, 2006, be held in the following manner. Nominations for union positions shall take place at a Chapter meeting in November. Names of the nominees will be forwarded to the American Arbitration Association. The American Arbitration Association shall then conduct the election via electronic voting / U.S. Postal system or both during the first two weeks of December. The AAA will tally the votes and election results shall be distributed via the United States Postal System to all Chapter members before December 31. The AAA will certify the election. • Amendment Proposal # 3 Members of the Chapter (in good standing) shall be eligible for nomination and for election for a position as an officer of the union. An individual elected to an office in the union shall be limited to holding that position for up to four (4) consecutive years at which time the individual must be out of that office for at least one year before being eligible to run for that office again. • Amendment Proposal # 4 Each member of the Dowling College Negotiating Committee shall be given a stipend that is equivalent to 3 overload credits for his/her membership on the Negotiating Committee during a period of full contract negotiations. These stipends will be awarded to each member of the Negotiating Committee not later than one month after a new contract has been ratified by the Chapter. In order to be eligible for the full stipend, a member of the Negotiating Committee must fulfill all of his/her responsibilities and service to the Committee. The Chair of the Negotiating Committee and the President of the Chapter shall each receive 6 overload credits pay as compensation for his/her work with negotiations as a stipend. All of the stipends herein cited will be paid at the prevailing overload pay rate in the newly ratified contract.

Health Care Coverage • Chapter Position in July, 2006 GRIEVANCE / ARBITRATION • Meeting with College Attorney August 21, 2006 Chapter took the position that the 2004-2007 Dowling College Health Care Booklet with VYTRA was still in force via the Faculty Agreement 2004-2007; via IRS rules about elected plan terms; and via mandatory items for negotiation between the parties. The Chapter presented to the College multiple examples of diminution of services; faculty members being forced out-of-network with the impact being increased costs; unavailable in-network services; problems with PCPs and Cards; problems re pre-existing conditions and exclusion from coverage; problems with change from PPO to other plan; etc. Meeting August 31 / Not Held. • Status of Matters / September, 2006 Members of the Chapter were advised that documents related to CIGNA services should be signed with the designation “under protest” placed near any required signature. The College has been reminded that an employer cannot negotiate directly with employees in a unionized workplace. An overture has been made to the College to have a follow-up meeting to the August 21, 2006 meeting.

School of Aviation Investigation • During the Summer, 2006 the Chapter presented to the BOT information about the operation of the School of Aviation and demanded a BOT investigation • NYSUT was informed that an investigation was activated • The situation essentially involved what appeared to be a private company taking over an area of the College’s academic mission with various apparent employee entanglements and apparent financial arrangements • The Chapter has been informed that several personnel changes have been expedited… the Dean has been removed; two temporary FT faculty have resigned their positions; new Chairs for the Aviation Department and the School of Aviation FDCC have been installed; and, an interim Dean has been put in place • The situation still merits monitoring and the Chapter will do so
