    2. EVOLUÇÃO DA LEGISLAÇÃO E DA TERMINOLOGIA CONSTITUIÇÕES ANTERIORES: - DESVALIDOS; - EXCEPCIONAIS. EMENDA CONSTITUCIONAL N° 12/1978 - DEFICIENTES - ANO INTERNCIONAL DA PESSOA DEFICIENTE ONU -1981 CF DE 1988 – PESSOA PORTADORA DE DEFICIÊNCIA - CONVENÇÃO SOBRE OS DIREITOSDAS PESSOAS COM DEFICIÊNCIA – ONU - 2006

    3. CLASSIFICAÇÃO PERÍODO IMPERIAL – INSTITUTOS E ASILOS: ASILO DOS INVÁLIDOS DA PÁTRIA; INSTITUTO DOS MENINOS CEGOS; INSTITUTO DE SURDOS- MUDOS. MANUTENÇÃO DESTA DIVISÃO MUNDIALMENTE ACEITA, ACRESCIDA DE : LOUCOS, DOENTES MENTAIS, RETARDADOS E EXCEPCIONAIS.

    4. LEI n° 7.853/89 e DECRETO n° 914/93 Art. 3° - Considera-se pessoa portadora de deficiência aquela que apresenta, em caráter permanente, perdas ou anormalidades de sua estrutura ou função psicológica, fisiológica ou anatômica, que gerem incapacidade para o desempenho de atividade, dentro do padrão considerado normal para o ser humano. REVOGADO

    5. DECRETO N° 3.298/1999 Art.3° I – deficiência – toda perda ou anormalidade de uma estrutura ou função psicológica, fisiológica ou anatômica que gere incapacidade para o desempenho de atividade, dentro do padrão considerado normal para o ser humano; II – deficiência permanente – aquela que ocorreu ou se estabilizou durante um período de tempo suficiente para não permitir recuperação ou ter possibilidade de que se altere, apesar de novos tratamentos; e

    6. DECRETO N° 3.298/1999 …III – incapacidade – uma redução efetiva e acentuada da capacidade de integração social, com necessidade de equipamentos, adaptações, meios ou recursos especiais para que a pessoa portadora de deficiência possa receber ou transmitir informações necessárias ao seu bem-estar pessoal e ao desempenho de função ou atividade a ser exercida.
