Introduction: • This presentation aims at describing the Presidential Instruction Number 9/2000 on Gender Mainstreaming in the National Development. • This Presidential Instruction was issued in Jakarta on 19th of December 2000 by the President of the Republic of Indonesia, Abdurrahman Wahid. • This Presidential Instruction came into force as of the date of approval. @University of South of Australia, Adelaide, October 26, 2008

Considerations: (1) • That in order to enhance the position, roles and quality of women as well as to realize gender equity and equality in the family, community, life of nations and the states, it is necessary deemed to implement Gender Mainstreaming throughout National Development process; • That Gender Mainstreaming is an integral part of the functional activities of all government agencies and institutions at the central and regional level. @University of South of Australia, Adelaide, October 26, 2008

Consideration (2) • That in relation with the above statements and within the framework of motivating, increasing effectiveness and maximising gender mainstreaming efforts in an integrated and coordinated manner, it is deemed necessary to issue a Presidential Instruction. @University of South of Australia, Adelaide, October 26, 2008

  6. Basis of Laws: • The President of the Republic of Indonesia holds the power over the government in accordance with the Constitution [Article 4, paragraph 1 of the 1945 Indonesian Constitution] • All citizens, without exception, are equal before the law and in government and have the duty to respect the law and the government [Article 27, paragraph 1 of the 1945 Indonesian Constitution] • Act Number 7 of 1984 on the Ratification of the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW). @University of South of Australia, Adelaide, October 26, 2008

This Instruction is directed at: • The Ministers in Cabinet; • The Attorney General of the Republic of Indonesia; • The Commander of Indonesian Army; • The Chief of Policy of the Republic of Indonesia; • The Heads of Non-Departmental Government Institutions; • All governors of the Provinces; • Heads of districts/mayors. @University of South of Australia, Adelaide, October 26, 2008

  8. Content of Instruction: (1) • To implement the Gender Mainstreaming in the National Development Policies and Program through mainstreaming gender concerns into planning, organising, implementation, monitoring, and evaluation in accordance with the roles, functions, and authorities. • To pay serious attention to the Technical Guidelines for the implementation of Gender Mainstreaming in the National Development attached to this Presidential Instruction. @University of South of Australia, Adelaide, October 26, 2008

  9. Content of Instruction (2) • The Ministry of Women’s Empowerment should: (1) provide a technical assistance to government agencies and institutions at the central and regional level for the implementation of gender mainstreaming. Terminology (1) • Gender mainstreaming is a strategy to integrate gender concern in all steps of national development process, i.e. planning, budgeting, implementation, monitoring and evaluation of national polices and programs (Part I, Point 1 of Attachment) • Gender is a concept referring to the roles and responsibilities of men and women, which have been socially constructed and may be changed by society and culture (Part I, Point 2 of Attachment) @University of South of Australia, Adelaide, October 26, 2008

  13. Terminology (2) • Gender Equality is a balance and an equal conditions of men and women in terms of human rights, roles in politics, economy, culture, defence and national security. It is also the balance and equal condition to acquire opportunities, a right as human being and to obtain the benefit from development itself (Part I, Point 3 of Attachment) • Gender equity is a process to achieve an equal and fair condition between men and women. Terminology (3) • Government agencies and institutions at central and regional level are government agencies and institutions which are led by a Minister, Attorney General of the Republic of Indonesia, Commander of the Indonesian Army, Chief of Police of the Republic of Indonesia, Head of Non Department Government Institutions, Governors, Head of Districts and Mayor (Part I, Point 5 of Attachment ] @University of South of Australia, Adelaide, October 26, 2008

Objective:(Part II of Attachment) • The objective of gender mainstreaming is to incorporate gender concerns and perspectives on the national development programs throughout the different moment of the development process (i.e. planning, organising, implementation, monitoring) to make gender equality real in the family, in the community, the life nations and states. @University of South of Australia, Adelaide, October 26, 2008

Methodology: (A-1)(Part IV of Attachment) • Gender Mainstreaming shall be implemented through: • Gender analysis: Gender analysis shall be conducted to identify and understand the problem, and causes of gender inequality and inequity, including avenues to overcome the problems. • Information, education and communication on the government agencies and institutions at central and regional/local level: Information, Education and Communication (IEC) activities shall be conducted to establish and promote the capacity of government agencies and institutions, at central and regional levels, regarding gender mainstreaming. @University of South of Australia, Adelaide, October 26, 2008

Methodology : (A-2) • Gender Analysis activities include: • To identify gaps between men and women in retaining benefits from development policies and programs in the various aspects of life. • To identify and understand the causes of gender inequality and inequity and to compile causal factors; • To develop an action plan and organise steps necessary to achieve gender equity and equality; • To justify and determine indicators to measure the efforts to achieve gender equality and equity. @University of South of Australia, Adelaide, October 26, 2008

  21. Technical Assistance: (B-1)(Part IV-B of Attachment) • The Minister of Women Empowerment provides technical assistance to government agencies and institutions at central and regional level in accordance with its duties, functions and authorities; • Such technical assistance may take the form of guidance, training, consultation, information, coordination, advocacy and provisions of materials and data. @University of South of Australia, Adelaide, October 26, 2008

  22. Strengthen the Implementation (C-1): In order to strengthen the implementation of gender mainstreaming, heads of government Agencies/institutions at central and regional level should: • establish a special unit in order to implement the gender mainstreaming on their agencies. • Prepare the steps for implementation of gender mainstreaming. @University of South of Australia, Adelaide, October 26, 2008

  23. Strengthen the Implementation (C-2): 3. Carry out internal coordination related to the scope of duties to ensure the implementation process of gender mainstreaming. 4. Provide a technical assistance in terms of data and information provisions, information, training and consultation as well as the authorities to the third parties when required. @University of South of Australia, Adelaide, October 26, 2008

  24. Monitoring and Evaluation: (Part IV-D of Attachment) • Chairs of government agencies/institutions, at national and regional levels, are responsible for evaluating and monitoring the implementation of gender mainstreaming. • The monitoring and evaluation results should be reported to the President, with a copy to the Minister of Women Empowerment. @University of South of Australia, Adelaide, October 26, 2008

  25. Financing (Source of Budgets):(Part V of Attachment) • All funding required to implement the gender mainstreaming shall be charged to: (a) The National Income and Expenditure Budget (APBN) the individual government agencies/institution at central level; (b) The Local Income and Expenditure Budget (APBD) for the individual government agencies/institution at regional level. • Any funds from the third parties, other than APBN and APBD, need to be aligned with prevailing acts and regulations . @University of South of Australia, Adelaide, October 26, 2008

  26. Reporting:(Part VI of Attachment) • The Minister of Women Empowerment shall be responsible for reporting annually on the implementation of gender mainstreaming to the President of Republic of Indonesia. • The report should include: (a). Problems and constraints on gender issues, (b). Efforts which have been carried out in addressing those problems and constraints. • The achievement and results which have been achieved in the implementation of gender mainstreaming. @University of South of Australia, Adelaide, October 26, 2008
